LAKE ELMO CITY COUNCIL MINUTES DECEMBER 3, 1991 7 <br />Mayor Johnson indicated he would be willing to rezone this <br />property with a strip of land providing a reasonable buffer <br />between this property and the Hammes Mining Property. <br />Discussion followed on adding a condition to the preliminary plat <br />that the property owner provide a 200' buffer (open space <br />preservation) easement along its common border to adjacent <br />properties until some future time. There was no agreement reached <br />on providing such a buffer between the City and the developer of <br />Stonegate. <br />M/S/F Hunt/Williams - to adopt Ordinance 8059, Rezoning of <br />Stonegate. (Motion Failed 3-1-1: Mayor Johnson, Abstain: Mottaz). <br />M/S/ Williams/Dick Johnson - to direct the city attorney to <br />report back to the city council at the next meeting on options <br />that the city can take to recover attorney fees awarded by the <br />court and also any penalties imposed by the court due to the <br />failure of rezoning and recover those costs from Mayor Johnson <br />and Councilman Mottaz. <br />M/S/F Mayor Johnson/Mottaz - to amend the motion to add while the <br />City Attorney is doing this he would like him to determine if <br />circumvention of the state statute with regard to rezoning <br />constitute a violation of the oath and; therefore, is it grounds <br />for removal of these three councilmen. (Motion Failed 2-3: Hunt, <br />Councilman Johnson, Williams). <br />M/S/P Williams/Dick Johnson - to direct the city attorney to <br />report back to the city council at the next meeting on options <br />that the city can take to recover attorney fees awarded by the <br />court and also any penalties imposed by the court due to the <br />failure of rezoning and recover those costs from Mayor Johnson <br />and Councilman Mottaz.
