LAKE ELMO CITY COUNCIL MINUTES <br />DECEMBER 3, 1991 6 <br />M/S/P Dick Johnson/Mottaz - to add the Hammes Property <br />Update to the agenda. (Motion carried 5-0). <br />Jim McNamara reported the clean up process on the Hammes property <br />was progressing slowly and provided pictures. Receipts for <br />removal of tires were submitted to the Council. <br />Councilman Williams indicated Hammes Mining has started hauling <br />gravel out from 10th Street. The mining operation now <br />encompasses the entire property and should be addressed by the <br />Council when reviewing the CUP. Also, the barn has not been <br />touched which was to be cleaned up by November. <br />The Council set Saturday, January 4th, 9:00 a.m. as a Council <br />walk-thru of the Hammes Property. The Building Official will <br />check the Council's schedule on dates set for cleanup. <br />C. Adoption of Comprehensive Plan, Resolution No. 91-41 <br />Mayor Johnson indicated he would be in favor of adopting this <br />Resolution if the words, "AND SUPERSEDES" be deleted in first <br />paragraph and to direct the Planning Commission to review the <br />differences between the Comp Plans and determine those items <br />that should be deleted or inserted. <br />Councilman Williams asked the City Attorney the following <br />questions: <br />Does deletion of "supersedes" impair the effectiveness of the <br />resolution? Attorney Filla answered the word "supersedes" was <br />inserted to try and help clarify where the city is on this issue. <br />Without this wording it is less clear, but with the resolution it <br />certainly is more clear than it is now. <br />Would the Future Land Use Map amended by this resolution? <br />Attorney Filla answered that this resolution deals with the <br />booklet entitled, 111990-2010 Lake Elmo Comprehensive Plan" <br />including all the maps that are in it. <br />MIS/ Dick Johnson/Williams - to adopt Resolution No. 91-41, <br />M/S/P Mottaz/Mayor Johnson - to <br />wording "AND SUPERSEDES" in the <br />41. (Motion carried 4-1:Hunt:I <br />to what the intent was and that <br />"supersedes" at the last council <br />amend the motion by deleting the <br />second line of Resolution No. 91- <br />feel I wanted to make it clear as <br />is why I suggested the wording <br />meeting). <br />M/S/P Dick Johnson/Williams - to adopt Resolution No. 91-41, as <br />amended, A Resolution Adopting the Lake Elmo 1990 Comprehensive <br />Plan.
