The <br />ordinary high water (OHW) elevation is 930 and the 100 year high water <br />level (HWL) is 931. The required setback for the principal structure is <br />100 feet from the ordinary high water elevation (930). <br />The applicant has stated that the proposed porch structure will setback <br />51 feet from the ordinary high water elevation. That setback distance <br />cannot be verified on the scale drawing submitted by the applicant <br />because only the 100 year elevation (931) is shown and the ordinary high <br />water level (930) is not drawn on the site plan. <br />i recommend denial of the variance request for the following reasons: <br />1. The existing house and deck does not conform to the required 100 <br />foot setback from the OHW (930). <br />2. Although two feet shorter, the construction of a completely <br />enclosed three season porch will be a larger visual encroachment <br />upon the shoreland setback standards than the existing deck. <br />3. No hardship has been demonstrated by the applicant. <br />
