(Motion carried 5-0). <br />6. PLANNING/LAND USE & ZONING: <br />A. Stonegate - Final Plat (Continuation) <br />Parkland Dedication: <br />Jim Peterson: In Phase I there is 90.98 acres and the area <br />in parks and trails is 6.78 acres that is determined by <br />survey. 7% of 90.98 acres is 6.37 acres so he is .41 acres <br />in excess in Phase I in land only in terms of park <br />dedication. Because the active park is in Phase I, there is <br />not enough land in Phase II so he will be approx 6.25 acres <br />short of total land dedication. The cash equivalent will be <br />about $16,000 for Phase II. Total on the whole plat is the <br />active park, the trail all the way over to Keats Avenue and <br />$16,000-16,500. <br />The estimate to grade a trail in Phase I is $1,050. The <br />estimate to base Phase I is $7,665, 8' wide 4" crushed <br />limestone. Bituminous on an 8' width is $3.50 per lineal <br />foot. Phase II grading is $1575, 4" of base is $11,500. <br />TOTAL TO GRADE AND BASE both Phase I and II: approx $22,000. <br />Proposal by Peterson: since $7,665 for him is a lot to <br />carry for two years, he be allowed to carry the .41 acres as <br />a credit for park dedication in Phase II, grade in trails at <br />a cost and credit not to exceed $1,050 as approved by the <br />City Engineer. <br />All of the monuments on the corners of the park land will be <br />shown on the Final Plat and will be marked with irons and <br />stakes. <br />City Attorney review and approve title or abstract to this <br />property. <br />Attorney Filla has reviewed evidence of title which <br />indicates that the applicant is the owner. <br />Restrictive covenants: <br />Attorney Filla recommended a statement be placed in the <br />covenants indicating this property is located adjacent to <br />land being used for a mining operation. Anybody who buys <br />this property and examines title would find the lot subject <br />to easements and restrictions of record. <br />
