LAKE ELMO CITY COUNCIL MINUTES APRIL 21, 1992 6 <br />Street Access easement over Phase II: <br />Jim Peterson explained the property was subject to mortgage <br />and a street access easement over Phase II was better than a <br />blanket easement. Councilman Johnson asked if he was <br />willing to dedicate the right-of-way for the road as opposed <br />to just granting the city an easement over that property. <br />Attorney Filla pointed out the City's purpose can be served <br />either way. If you dedicate this as part of the plat, you <br />have the right to use that for road and utility purposes. <br />If you decide not to use it for that purpose in the future, <br />then you vacate part of the road which reverts back to <br />adjoining property owners. If you word the easement <br />properly, you can acquire the same use rights over that <br />particular area. Dedication at this point would require the <br />roads to be part of Phase I of the plat which could create <br />some financing problems. <br />Councilman Johnson stated he had two objectives: 1. is to <br />guarantee the city that we don't end up with an illegal cul- <br />de-sac,and 2. be consistent from one development to another. <br />Peterson will provide legal descriptions to the City <br />Attorney for the road and drainage easements in Phase II. <br />Street Design: <br />M/No Second Hunt/No Second - the city waives its engineering <br />roads standards in the Stonegate Final Plat to allow 24' <br />road width with rollover bituminous curbs <br />M/S/P Hunt/Dick Johnson - the city waives its engineering <br />road standards in the Stonegate Final Plat to allow a single <br />road type of 28' width with bituminous rollover curbing <br />based on the recommendation from the Maintenance Foreman <br />that we not mix curb and ditch within the same development <br />to aid in plowing. (Motion carried 5-0). <br />Radius of Cul-de-Sac with Islands <br />The City Council and Maintenance Foreman will meet at the <br />The Forest, Wednesday, 5:30 p.m. fora demonstration on <br />plowing a cul-de-sac to determine the desired radius of a <br />cul-de-sac. <br />M/S/P Mayor Johnson/Mottaz - to accept the islands in the <br />cul-de-sacs with the appropriate radius that would work for <br />the City as determined by discussions between the City <br />Engineer, Maintenance Foreman and Developer. (Motion carried <br />5-0). <br />
