LAKE ELMO CITY COUNCIL MINUTES MAY 5, 1992 9 <br />Attorney Filla indicated the problem he saw with the City <br />( code is that we broadly define Alternative Ag Uses which <br />allows these kinds of things that Councilman Mottaz refers <br />to. It sounds there is also an enforcement problem if there <br />is expansion of the use without amending the CUP and <br />buildings are being constructed without a permit. <br />Councilman Williams made the following motion in order to <br />prevent any conditional use allowed in any zoning district. <br />The City will be dealing with only the uses specified by <br />ordinance for any particular zoning district. <br />M/S/P Williams/Hunt - to direct the city staff to prepare an <br />ordinance to amend 301.060D.1 of. the City Code. The first <br />sentence should read: "Conditional Use Permits may be <br />granted or denied in any district by action of the zoning <br />body according to the standards for that district." and the <br />rest of the paragraph would remain the same. (Motion <br />carried 5-0). <br />G. MUSA UPDATE: <br />The City Administrator reported she met with the Met Council <br />and presented a draft copy of a proposed Comp Plan amendment <br />that would retain a portion of the 76,700 gallons per day in <br />the portion of the MUSA remaining in Lake Elmo and transfer <br />the rest to the 120 acres, and it appeared to be well <br />received. The Met Council will be getting back to her with <br />their comments. <br />Mayor Johnson and Administrator Kueffner indicated they <br />received a verbal commitment from George Burgard, and the <br />city will be receiving $2,000 escrow with a letter by <br />Friday. <br />Councilman Williams indicated he was not interested in <br />unduly prolonging this process, however, we are under no <br />time limit and was not interested in having the City spend <br />any more money until he, as a Councilman, see this written <br />commitment for an escrow fund. <br />Mayor Johnson and Councilman Mottaz responded they would <br />donate their salaries to cover this $2000 escrow in order <br />for the City to proceed. <br />7. CITY ENGINEER'S REPORT: <br />Tom Prew reported this is the year for the City to do <br />sealcoating and the County does not do sealcoating anymore. <br />Prew will ask the West Lakeland engineer about going <br />together on a joint sealcoating project. <br />
