LAKE ELMO CITY COUNCIL MEETING JUNE 16, 1992 7 <br />MIS/ Williams/Mayor Johnson - to direct the city staff to <br />prepare a resolution stating the city will henceforth <br />consider conditional use permits and site plans of all land <br />included within the CUP together and any modification of the <br />land or structures within the conditional use permit shall <br />require an amendment to the CUP. <br />Councilman Williams made the following amendment because a <br />discrepancy had been pointed out. Our ordinance states in a <br />normal CUP the site plan includes only that area regulated <br />by the conditional use and does not include the rest of the <br />Ag property. However in the Alternative Ag use, our <br />ordinance clearly states that all of the landowners <br />contiguous real estate shall be included in the granted CUP. <br />We should make it clear that the site plan for the Alternate <br />Ag Use shall include all of the landowners contiguous real <br />estate. <br />M/S/P Williams/Dick Johnson - to amend the motion to include <br />the site plan for an Alternate Ag Use shall include all the <br />landowners contiguous real estate. (Motion carried 3-1: <br />Mayor Johnson: we have to go back to the whole idea of a CUP <br />and spend time on this and act rationally and reasonably and <br />come up with something that will satisfy us so we can <br />present to the public and ask for their comments). <br />M/S/P Williams/Mottaz - to direct the city staff to prepare <br />a resolution stating the city will henceforth consider <br />conditional use permits and site plans of all land included <br />within the CUP together and the site plan for an Alternate <br />Ag Use shall include all the landowners contiguous real <br />estate and any modification of the land or structures within <br />the conditional use permit shall require an amendment to the <br />CUP. (Motion carried 4-0). <br />6. PLANNING/LAND USE & ZONING: <br />A. PUBLIC HEARING: Shoreland Permit & Variance <br />to required 100, setback for structures, <br />Jeff Leitch, 9025 Jane Road N. <br />Councilman Williams asked if all the documents required by <br />our ordinance for an application of this type are in hand. <br />The Building Official stated the materials provided did not <br />contain the legal description of the property, the required <br />site plan details or a soil analysis. <br />Mayor Johnson opened up the public hearing at 10:28 p.m. <br />
