LAKE ELMO CITY COUNCIL MEETING JUNE 16, 1992 10 <br />9. CITY COUNCIL REPORTS: <br />Kunz Oil <br />Mayor Johnson explained Label Lawn has been running a retail <br />operation selling sod out of the Kunz Oil property. The <br />owners of Label Lawn have called the Mayor and requested <br />they be given an opportunity to stay there until the end of <br />this year, because the city is pursuing removing that use <br />from the property because it does not fit our Highway <br />Business Zoning. <br />The City Administrator added these same people were directed <br />to come to a Council meeting and get their request <br />formalized which was for temporary selling of sod that was <br />stockpiled, but chose not to do so. <br />The Building Official stated Label Lawn does not meet the <br />Highway Business zoning and has illegal outside storage. <br />McNamara added no one had contacted him and felt he was not <br />in fault in issuing the formal complaint. Councilmen Johnson <br />and Williams indicated they felt the city staff has taken <br />appropriate action and is proceeding properly. <br />Councilman Mottaz and Mayor Johnson indicated they felt <br />under broad interpretation, sod could be considered seasonal <br />produce and allowed. <br />Prosecuting Attorney: <br />Councilman Johnson noted the six month trial of our <br />prosecuting attorney has ended and asked for an <br />administrative review from the staff for the next meeting. <br />If the report warrants, we will invite the attorney in. <br />10. CITY ADMINISTRATOR'S REPORT: None <br />M/S/P Mottaz/Dick Johnson - to adjourn the council meeting <br />at 11:30 p.m. (Motion carried 4-0). <br />
