Derrick Lots Attorney Filla reported that he, Larry Bohrer, Mr. Derrick and his attorney and consulting engineer, were present at the site and heard the reason for the activity observed. When the representatives were monitoring the site to determine water levels, of the they concluded that part reason the water elevation was not of was because of the nature of soil conditions between the bottom of the mound and the curtain drain was impervious and they might improve the statistics by replacing that soil.
