LAKE ELMO CITY COUNCIL MINUTES JULY 7, 1992 2 <br />Councilman Johnson pointed out that it was stated in the <br />minutes the Mayor indicated Councilman Johnson had a <br />legitimate reason for not being here because he was out-of- <br />town. Johnson objected to the fact the Mayor decided his <br />reason was legitimate. <br />M/S/F Mottaz/Mayor Johnson - that the minutes, as printed <br />for the special council meeting of June 9th, 1992, be <br />approved. (Opposed: Hunt, Dick Johnson, Williams). <br />Mayor Johnson declared that a vote, 2-3, to not approve the <br />minutes was invalid because he claimed that the three <br />opposed votes should not have voted since they did not <br />attend the meeting. <br />Councilman Mottaz felt a person not in attendance could not <br />vote to approve or disapprove minutes. <br />MIS/ Williams/Hunt - to appeal from the Chair's order <br />Mayor Johnson refused to hear the appeal from the Chair's <br />order. He would accept the appeal request and deal with it <br />as a protest and render his opinion at the next meeting. <br />Councilman Williams asked that the Mayor abide by Robert's <br />Rules, adopted by ordinance as set in the city code, and <br />call a vote on the appeal. He asked, where in these rules <br />does it say you can refuse to acknowledge this appeal? <br />Mayor Johnson explained he would suspend further action on <br />these minutes until he renders his opinion in two weeks. He <br />will give the page and verse of Roberts Rules that allows <br />him to disallow an appeal when it is dilatory. Mayor Johnson <br />withdrew his vote on the motion. <br />Councilman Mottaz indicated this DRAFT was an accurate <br />account of the June 9th minutes. He agreed to withdraw his <br />vote at this time until the Mayor rendered an opinion. <br />MINUTES: June 11, 1992 <br />M/S/P Hunt/Mottaz - to approve the June 11, 1992 Special <br />Council minutes as presented. (Motion carried 3-0-2: <br />Abstain: Williams, Dick Johnson). <br />MINUTES: June 16, 1992 <br />M/S/P Mottaz/Williams - to approve the June 16, 1992 City <br />Council minutes as presented. (Motion carried 4-0-1: <br />Abstain: Hunt). <br />
