LAKE ELMO CITY COUNCIL MINUTES JULY 7, 1992 3 <br />3. CLAIMS <br />M/S/P Mottaz/Hunt - to approve the July 7, 1992 claims #674 <br />thru #752 as presented. (Motion carried 5-0). <br />4. PUBLIC INQUIRIES/INFORMATIONAL <br />Margaret Carlson, 8735 27th St., congratulated Councilman <br />Lee Hunt on dismissal of a lawsuit filed against him <br />claiming he violated Minnesota's Open Meeting law. Carlson <br />added that Councilman Hunt has done an excellent job of <br />representing the city fairly, honestly, and with dignity. <br />Carlson spoke in favor of Mr. Soderberg's request for a <br />boarding stable next to the Regional Park. She thought this <br />would provide an excellent opportunity to fully utilize the <br />equestrian trails in the park and thought it was the type of <br />development that Lake Elmo should encourage. <br />Sue Dunn, 11018 Upper 33rd St., reminded the Council that <br />two people are not a quorum and at the June 9th meeting, the <br />Mayor threatened to have her removed from the meeting. Dunn <br />added that there are lots of people that like to hear you <br />read and suggested the Mayor donate some of his time to <br />"Talking Books". <br />5. PUBLIC HEARING: Vacation of a Portion of 34th Street <br />Mayor Johnson opened up the public hearing to consider the <br />vacation of a portion of 34th Street at 8:00 p.m. in the <br />Council Chambers. The public hearing notice was published <br />in the June 24, 1992 St. Croix Valley Press and required <br />property owners were notified. <br />There were no public comments against this vacation. <br />Dave Herreid, Wichser & Herreid Architects, has requested <br />vacation of a portion of 34th Street in order to gain clear <br />title to his property. Mr. Herreid owns the building now, <br />but plans on it being owned by a partnership. <br />Mayor Johnson closed the public hearing at 8:02 p.m. <br />Councilman Williams suggested adding the following amendment <br />to the proposed resolution. <br />WHEREAS, the infringing building is at least 70 years old <br />and has historic value, and it is undesirable to attempt to <br />move the building out of the right-of-way; and <br />M/S/P Williams/Mottaz - to adopt Resolution No. 92-12, as <br />amended, vacating a portion of 34th Street in Lake Elmo. <br />(Motion carried 5-0). <br />
