LAKE ELMO CITY COUNCIL MINUTES NOVEMBER 5, 1992 <br />B. Petition for buoys on Olson Lake <br />James Dillon reported he met with the Tri Lakes Association <br />which approved purchase of no -wake buoys, anchor chains and <br />anchors for the channel that connects Lake Demontreville and <br />Lake Olson. They have spoken with Washington County <br />Sheriff's Dept. who stated they will place and retrieve the <br />buoys and store them. <br />M/S/P Dick Johnson/Williams - to formally thank the Tri- <br />Lakes Association for purchase of no -wake buoys, anchors and <br />anchor chains and that the City requests the Washington <br />County Sheriff's Dept. place the buoys on the channel that <br />connects Olson Lake and Lake Demontreville. (Motion carried <br />5-0). <br />PLANNING/LAND USE & ZONING: <br />A. PUBLIC HEARING: Variance to structure setback from <br />rear property line and altering a non -conforming use. <br />Site & Plan Review: Twin Points Tavern <br />Mayor Johnson opened up the public hearing at 7:35 p.m, in <br />the City Council chambers. The public hearing notice was <br />published in the October 21, 1992 St. Croix Valley Press and <br />adjoining property owners were notified. <br />Twin Point Tavern is requesting a variance to structure <br />setback from the rear property line and for altering a non- <br />conforming use for the purpose of constructing a 14' x 36' <br />off -sale retail liquor store. <br />There was no one to speak for or against the request. <br />Mayor Johnson closed the public hearing at 7:36 p.m. <br />M/S/P Hunt/Williams - to grant three variances: (1) a 10' <br />variance to the rear yard setback, (2) a variance to the <br />number of parking spaces required and (3) a variance to <br />expand a non -conforming use to Twin Point Tavern/Dennis <br />LaCroix, 11199 Stillwater Blvd., based on the following <br />Findings of Fact: that this building was located prior to <br />the adoption of our code, the city favors maintaining a <br />viable business community, and with the historical fact that <br />the Old Village has many small lots, there is no possibility <br />of expansion because adjacent land is not available to <br />purchase, it does not require expansion to the septic <br />system, it does not increase the amount of impervious <br />surface, appears to be the minimum variance allowed <br />necessary to accomplish the applicant's desire, and to <br />approve the site plan by McCombs, Frank, Roos, Assoc, dated <br />
