LAKE ELMO CITY COUNCIL MINUTES JANUARY 19, 1993 4 <br />Attorney Filla suggested amending the ordinance by deleting <br />"publicly dedicated" in Item 3, <br />Item 3 should read: <br />3. ......shall be served by a restrictive access which is <br />protected by a restrictive covenant which includes the city <br />as a beneficiary. <br />M/S/P Mottaz/Johnston - to adopt Ordinance 8078, as amended, <br />An ordinance that ordains that Section 401.042(A)2. is <br />hereby amended and Section 401.042(A)3. is hereby added to <br />the Lake Elmo Municipal Code. (Motion carried 5-0). <br />B. Keith Raleigh/Joe Slomkowski <br />(1) Rezoning from AG to RR <br />M/S/P Mottaz/Conlin - to direct the staff to draft an <br />ordinance for rezoning 40 acres owned by Keith Raleigh from <br />Agriculture to Rural Residential recognizing the creation of <br />a legal non -conforming use of the accessory buildings. <br />(Motion carried 5-0). <br />(2) Minor Subdivision <br />(3) PUBLIC HEARING: Variance for frontage on a <br />dedicated & improved road <br />Attorney Filla pointed out that the only variance needed is <br />to the requirement of the 300' of road frontage on an <br />improved road. If there are concerns by the council, they <br />could be attached as conditions to approval of a variance. <br />Mayor John opened up the public hearing at 8:50 p.m. in the <br />City Council chambers. The public hearing notice was <br />published in the December 30, 1992 St. Croix Valley Press, <br />Joe Slomkowski stated he plans on building only one home on <br />the 20 acres and would be willing to work with Mr. Dege on <br />constructing a driveway that would not add runoff onto his <br />property. <br />George Dege, 5193 Keats Avenue N., stated he would like to <br />have Joel and his wife as neighbors, but voiced his concern <br />on the runoff from the slew at the bottom of the hill on the <br />road that is proposed which goes along his borderline. At <br />the Planning Commission it was brought up there is no <br />standards for a private access road, and they asked for <br />direction from the engineer or DNR for guidelines on <br />preparing the roadbed. <br />Larry Bohrer explained this will be a driveway for a single <br />home and there are no standards for driveway construction. <br />The responsibility is on the homeowner. <br />Mayor John closed the public hearing at 9:05 p.m. <br />
