LAKE ELMO CITY COUNCIL MINUTES JANUARY 19, 1993 5 <br />M/S/P Mottaz/Conlin - to direct the staff to draft the <br />appropriate resolution granting the variance to Section <br />301.090 I of the zoning code subject to the following <br />conditions: (Motion carried 5-0). <br />1. Payment of a park dedication fee in the amount of <br />$700 for Parcel E. <br />2. Preparation and submittal of restrictive covenants <br />which guarantees access from Keats Avenue to <br />Parcel E to be reviewed by the City Attorney prior <br />to issuance of the building permit for Parcel E. <br />3. An agreement from the owner of Parcel E that the <br />current access to Keats Avenue would be vacated and <br />the area restored. In the future if a road is <br />constructed to the east of Parcel E, this can be <br />used as a publicly dedicated right-of-way. <br />4. The width of the access shall be 30' and the <br />improved surface of the access will be at least 5' <br />north of the south property line. <br />5. The plans and specs for the construction of the <br />access drive will be submitted to the city engineer <br />for review and costs incurred by the city for <br />engineering review be paid by the property owner. <br />6. Lots be treated equally for purpose of any <br />assessments. (City Engineer explained public <br />improvements and assessing costs is based on <br />benefit. He suggested the way of doing this is to <br />assess on a unit basis as opposed to a front <br />footage basis). <br />7. The back lot, even though it is a nominal 20 acres <br />and zoned RR should be subdividable, that in this <br />case because of the variances being requested that <br />this property not be subsequently dividable unless <br />served by a public road. <br />This resolution will be brought back to the city council. <br />B. Gene Peltier <br />(1) Minor Subdivision <br />(2) PUBLIC HEARING: Variances to lot configuration; <br />the required 250' circle and the 3:1 lot ratio <br />Mayor John opened up the public hearing at 9:25 p.m. in the <br />City Council chambers. The public hearing notice was <br />published in the December 30, 1992 St. Croix Valley Press. <br />
