LAKE ELMO CITY COUNCIL MINUTES JANUARY 19, 1993 7 <br />M/S/P Mayor John/Conlin - to add establishing an ordinance <br />for an Historical Overlay District in the Old Village to the <br />Planning Commission's work plan. (Motion carried 5-0). <br />D. Resolution No. 93-7, Adopting Thoroughfare Plan <br />M/S/P Johnston/Conlin - to approve Resolution No. 93-7, as <br />amended (include history of public hearing), Adopting the <br />Thoroughfare Plan approved at the December 15, 1992 Council <br />meeting. (Motion carried 5-0). <br />E. Septic Ordinance requiring manholes to be brought <br />up to surface retroactive to 1984 <br />The new council members have stated that while they were <br />door -knocking during the last election there were many <br />comments about the ordinance requiring manholes to be <br />brought up to grade. The concerns expressed were on the <br />unfairness of the retroactive portion of the ordinance. Many <br />of the residents that were on the 201 program felt it <br />unreasonable to force them to change something that complied <br />with our code, especially when it was a city project. <br />M/S/F Conlin/Johnson - to direct the staff to prepare an <br />ordinance eliminating the retroactive portion of the septic <br />ordinance as it relates to bringing manholes up to grade for <br />the next meeting. (Motion failed 2-3:John, Johnston, <br />Mottaz) <br />7. CITY ENGINEER'S REPORT: <br />Larry Bohrer explained the differences between sealcoating <br />and crackfilling. <br />8. OLD BUSINESS• <br />A. Request from NHD (Cimarron Park Owners) regarding <br />storm shelters <br />At their October 6, 1992 meeting, the city council <br />determined the storm shelter capacity of Cimarron shall be <br />satisfied by two shelters and that the population to be <br />accommodated at 100% utilization as required by the state <br />shall be according to the 1990 census. <br />The Mayor and City Administrator received a letter from <br />Peter Herfurth, NHD, requesting council approval for one <br />large storm shelter and that the city issue a bond to <br />finance this project with a direct assessment back to the <br />property owner. <br />M/S/P Conlin/Johnston - to not change the previous council <br />action. NHD will finance the construction itself for two <br />storm shelters to be in place by May 1 to meet the state's <br />requirement. (Motion carried 5-0). <br />
