LAKE ELMO CITY COUNCIL MINUTES JANUARY 5, 1993 10 <br />B. Letter from Minnesota Pollution Control Agency <br />The City received a letter from David Douglas, MN Pollution <br />Control Agency, requesting a questionnaire for Washington <br />County landfill and Request for Production of Documents. <br />The MPCA is responsible for implementing the MN <br />Environmental Response and Liability 'Act (MERLA). MERLA is <br />the cornerstone of the state's efforts to investigate and <br />remedy sites where there are releases of hazardous <br />substances of pollutants or contaminants to protect public <br />health, welfare, or the environment. <br />M/S/P Johnson/Conlin - to direct the City Administrator to <br />seek whatever sources are required to provide the answers to <br />this questionnaire and to respond within the time limit of <br />30 days from receipt of the letter (12/28/92) and the final <br />answers to the questionnaire be reviewed by the City <br />Attorney. (Motion carried 5-0). <br />C. Letter from Mn/DOT regarding TH 36 <br />Jess Mottaz, the City's representative to this committee, <br />gave a brief summary as to why this group was formed. Mayor <br />John voiced his concern if Councilman Mottaz was the <br />appropriate city's representative because he owns frontage <br />along Highway 36. <br />Councilman Mottaz indicated it was stated that because he <br />owned property along Hwy 36 he probably had a conflict of <br />interest and therefore should not be a member of the Hwy 36 <br />study committee. The study committee has no legal decision <br />making authority; therefore,, no one serving on the study <br />committee will be found guilty of a conflict of interest as <br />defined by MN statutes. <br />M/S/P Johnson/Conlin - to accept Jess Mottaz's resignation <br />and appoint Wyn John as the city's representative to the <br />Mn/DOT Committee regarding TH 36. (Motion carried 5-0). <br />M/S/P Mottaz/Johnson - to adjourn the city council meeting <br />at 10:10 p.m. (Motion carried 5-0). <br />
