Old Business <br />At the December 15, 1992 meeting, Mayor Johnson brought up <br />several issues that he felt should be dealt with by the <br />city. The Council prioritized the issues as follows: <br />1. General Development of Properties with Surface Water <br />Flow to Eagle Point Lake <br />Larry Bohrer explained that formally the VBWD Rule and the <br />Lake Elmo Rule were the same in that the probability of <br />additional water leaving a site after development shall be <br />less than 1% applied to both rate and volume of water <br />running off. Oakdale successfully challenged the volume <br />portion of the Rule. Valley Branch is still able to enforce <br />the probability of additional rate of water leaving the site <br />shall be less than 1%, but they cannot enforce the volume <br />control. <br />Mayor John requested a legal opinion by the City Attorney on <br />why volume control is unacceptable and the possibility of <br />challenging this. <br />2. Old Village Waste Treatment Suggestions <br />3. Senior Housing <br />4. Ordinance to control use of fertilizer, pesticides, <br />and herbicides <br />5. Heritage Preservation Commission Ordinance Changes <br />Hiahwav 5 Land Use and Zoning_ <br />M/S/P Conlin/Johnston - to direct the City Administrator to <br />set up a workshop with the Lake Elmo City Council and <br />Planning Commission jointly with the Baytown Township Board <br />to discuss our common borders in February on an off PZ <br />Monday meeting or an off City Council Tuesday night. <br />(Motion carried 5-0). <br />Mayor John indicated he had been in discussion with 3M <br />planners and they are proposing to come in to talk to the CC <br />and PZ jointly so this workshop also has to be set up. <br />Detachment/Annexation Resolution: <br />Capt. McGlothlin, Washington County Sheriff's Dept., <br />reported that the Washington County surveyor has completed <br />his report and will have it delivered to the City <br />Administrator on Wednesday so we will be able to proceed as <br />the former Mayor has suggested. <br />
