LAKE ELMO CITY COUNCIL MINUTES SEPTEMEER 7, 1993 <br />M/S/C Johnson/John - to adopt Ordinance 8089, as presented, adding Section 301.040 <br />117.1 and Section 301.070 D.1.b.(6) allowing Recording Studios in Ag Zoning District <br />based upon the 7 acre parcel is less than the 40 acres required in the Ag Zone, the <br />buildings on site, if left as is, would continue to comply in the Ag Zone, the proposed <br />use of a recording studio does not change the land or the exterior of the buildings, and <br />the discharge of the effluent from this facility is less than an equivalent Ag facility. <br />(Motion carried 4-1: Mottaz: Does not like to see City continue additional allowed uses <br />in the AG Zoning and turning the AG zone into a General Business zone). <br />B. Conditional Use Permit for Recording Studio in AG Zoning District <br />(Continued) <br />The Planning Commission held a public hearing on this request and recommended on <br />a 6-1 vote that this Conditional Use Permit be granted if the City is going to allow <br />recording studios in the AG zoning district. <br />M/S/C Conlin/John - to adopt Resolution No. 93-65 as presented, granting g a <br />conditional use permit to Richard Driscoll, Driscoll and Daughters, for recording studio <br />in AG Zoning District. (Motion carried 4-1:Mottaz: for reasons stated above ). <br />C. Comprehensive Plan Amendment - Goetschel/Klatt <br />MS/C John/Conlin - to approve the Comprehensive Plan amendment for the <br />Goetschel/Klatt property, changing the future land use designation from RAID to RED, <br />conditioned upon submitting this minor amendment to the Metropolitan Council and <br />receiving a determination from the Metropolitan Council Chair of no system impact. <br />(Motion carried 4-1:Mottaz: The adjacency provision of the 1979 Comp Plan still <br />remains as part of the revised Comp Plan and this amendment violates the 1979 comp <br />plan). <br />D. Resolution No. 93-66, Garage Placement -Myron Wendt, 11306 32nd St. N. <br />M/S/C Johnston/John - to adopt Resolution No. 93-66, A Resolution allowing an <br />accessory structure to be located between the public road and the principal structure <br />for Myron Wendt at 11306 32nd St. (Motion carried 5-0). <br />E. St. Croix Equestrian Center-Cty Rd. 17 & Cty Rd. 10 <br />M/S/C Mottaz/Johnston - to refer the development and maintenance of the <br />pedestrian/equestrian trail to the Parks Commission for their comments on whether or <br />not they would recommend to exercise Lake Elmo's options for the easements, would <br />they consider a Lake Elmo access to the Regional Park and report on the costs and <br />funding of such a city access and maintenance of those trails, and to send a letter to <br />the Washington County Parks and Open Space Commission for an update on their <br />position and what would their requirement be for an access. (Motion carried 5-0). <br />
