LAKE ELMO CITY COUNCIL MINUTES AUGUST 16, 1994 <br />M/S/P Mottaz/John - to instruct the City Administrator to thank Metro East for the <br />opportunity to review the Roadway Express Development Proposal. (Motion passed 5- <br />0). <br />G. Leonard Hanson property on 1-94 <br />Mr. Leonard Hanson, 10824 Hudson Blvd., would like to sell his property and he feels <br />is worth more than a single family structure. He has been taxed as a multi -unit <br />structure and has been able to homestead only a portion of the primary structure. <br />Filla reported the property is zoned Ag; therefore, can be used for those uses that are <br />permitted in the Ag zone or as conditional uses which have been approved for the site. <br />It is possible there may be some other uses that over a period of time the city has <br />allowed to continue and we might be estopped from asserting our regulations at the <br />present time. If a grandmother apartment was approved at one time, it was approved <br />for a specific use by a relative of the family. If that now has been converted to another <br />kind of use, that may be illegal. Filla would like to review the history behind this site. <br />M/S/P Johnston/Mottaz - to refer this matter to the city attorney to review the history <br />behind this site and determine if there are any other kinds of uses that we have <br />intentionally or inadvertently allowed to occur on this site that can now through legal <br />theory continue to exist. (Motion passed 5-0). <br />H. Planning Commission Request <br />The Council authorized the city planner to attend the August 23, 1994 planning <br />commission meeting to discuss the PUD Ordinance. <br />7. CITY ENGINEER'S REPORT: <br />A. Partial Payment #6 - Tower Asphalt <br />M/S/P Johnston/Johnson - to approve partial payment #6 in the amount of $25,697.05 <br />to Tower Asphalt for work on the 1993 MSA Project based on a favorable <br />recommendation from the city engineer. (Motion passed 5-0). <br />B. Rolling Hills: Escrow Reduction <br />Larry Bohrer reported the developer has completed the bituminous surfacing work on <br />the Rolling Hills Subdivision. Satisfactory bituminous inspection and testing was <br />performed. The only remaining work is some traffic signing (which is usually put up by <br />the public Works Dept. and paid by the Developer) and payment of outstanding pass - <br />through costs. The one-year guarantee provided for in the Developer's Agreement <br />would begin now. <br />
