The mitigation will be performed on Tom <br />Armstrong's property adjacent to the lake. lrt the agreement between the County and Armstrong, <br />all material excavated from the mitigation site is to remain on the Armstrong land and not hauled <br />away. <br />The County has prepared a plan which shows the placement of this excess soil. About 80,000 <br />CY of soil will be excavated for the mitigation. About 20,000 CY of the more suitable soil is <br />intended to be spread south and east of the southerly storage building and graded level. <br />Approximate depth of fill at this location is 7 feet. Side slopes will be topsoiled with seed and <br />mulch. <br />The topsoil material not needed at the mitigation site will be placed between the farmstead and <br />the red brick Armstrong house south of 15th Street. <br />All remaining soil will be placed south of the red brick house, west of CSAH 13 and north of an <br />existing field entrance. This land is presently lower than CSAN 13. These stockpile areas will <br />be leveledby the County's contractor but the turf establishment will be Mr. Armstrong's <br />responsibility. <br />The disposal and stockpile areas are shown on Sheet 64 of the CSAH 10 plans. I will have a <br />copy at the Council meeting. <br />Action Requested <br />I can find no specific administrative procedures in the City Code which address this type of <br />grading and filling; therefore, I thought it wise to bring this matter before the City Council. <br />Section 901..010E of the Mining Ordinance specifically exempts the moving of dirt within the <br />construction limits of a road project from mining regulations. <br />TFITCA G n7) <br />
