LAKE ELMO CITY COUNCIL MINUTES MAY 16, 1995 <br />B. Replace Mr. Boche's drainfield with a mound and grade his and Mr. Strege's yards to drain. <br />If the City wishes to correct this problem, Bohrer recommends solution A since it involves no work on <br />private property. <br />The third problem involves water flow easterly over Irwin Avenue causing gravel to wash on Mr. Strege's <br />property. The solution to this problem is to excavate a shallow ditch on the west side of Irwin Avenue and <br />construct a second culvert in the VBWD manhole at 36th Street and Irwin Avenue. The estimated cost of <br />this improvement is approximately $1,000. <br />The Council felt the project needs to be done, but questioned who pays. They asked the City Engineer to <br />come up with cost cutting suggestions (estimates based on using concrete pipe but may be able to use <br />plastic pipe) for the next Council meeting under OLD BUSINESS if we hear from the VBWD. <br />M/S/P Hunt/DeLapp - to direct the staff to contact VBWD to solicit their financial participation in this <br />project because it is the residents', in that area, belief the problem was made worse since the <br />construction of Project 1007. (Motion passed 5-0). <br />C. Signs on 33rd Street and 15thStreet Gravel <br />Larry Bohrer had not checked on these items and will accomplish both of these items this week. Mayor <br />John and Dan Olinger met with the homeowner involved and looked at the problem and discussed the <br />suitability of the Bob Cat for the job. <br />8. PARKS SUPERVISOR'S REPORT: <br />A. Tablyn Park Playground Equipment Proposals <br />At the May 15, 1995 meeting, the Parks Commission recommended the City accept the proposal <br />submitted by Gametime, for purchase of playground equipment for Tablyn Park, in the amount of $13,000 <br />with the option to change some of the components if Parks Supervisor, Mike Bouthilet, feels that it is <br />necessary. <br />M/S/P DeLapp/Conlin - to authorize staff to purchase and install the playground equipment for Tablyn <br />Park from Gametime in the amount of $13,000 as recommended by the Parks Commission. (Motion <br />passed 5-0). <br />B. Summer Parks Workers <br />The Summer Park Workers' position was advertised, posted, and applicants interviewed by the Parks <br />Supervisor. <br />M/S/P Conlin/Hunt - to approve hiring Kevin Day and Danny Olinger as Summer Park Workers at $6/1-1r. <br />with termination being end of September depending on monetary budget. (Motion passed 5-0). <br />9. CITY ATTORNEY'S REPORT: <br />At the last meeting the council decided not to acquire a right-of-way easement for Lake Elmo Heights 3rd <br />Addition. Upon further review, if the City wants to insure itself of control on that issue, you would want to <br />consider something differently. The Cities have the authority to acquire land or easements in other <br />communities if it is done for public purpose. Cities have the authority to extend utilities into another <br />community only if the host community consents. The statute in the case law that interprets that particular <br />statute have dealt primarily with gas, water, sewer and telephone and electric. If that were to occur in this <br />case on the border, it would have to be with the City's consent as part of a joint improvement project and <br />would have to be consistent with our road specifications.
