LAKE ELMO CITY COUNCIL MINUTES AUGUST 1, 1995 PAGE 6 <br />City Engineer Bohrer stated he has received a grading plan, dated July 27, 1995, from the <br />developer, and handed out an updated staff report, dated August 1, 1995, to the council <br />recommending the grading and erosion control plan is acceptable. <br />M/SIP Hunt/Johnston - to approve Case No. Sub/95-23 as presented, and grant a variance from <br />the Lot Ratio Standard for Lot 6, based on the findings: 1. The granting of this variance will not <br />be detrimental to the public welfare. 2. Due to the unusual layout of the land such as the creek <br />area and slopes, the granting of this variance is reasonable, and with the following conditions: 1. <br />The wetland delineation and bridge proposal plans and an as -built plan for the portion which has <br />already been constructed shall be reviewed and approved by the Valley Branch Watershed <br />District. 2. The permit from the DNR regarding the bridge shall be submitted to the City before <br />final plat approval. 3. The stormwater detention facilities shall be reviewed and approved by the <br />Valley Branch watershed District and the City Engineer. 4. A detailed landscape plan shall be <br />submitted and approved by the City as regulated by the landscape ordinance before final plat <br />approval. Additional landscaping shall be provided along Stillwater Blvd. 5. The park dedication <br />in -lieu fee shall be established before final plat approval. 6. All comments from the City Engineer <br />in his letter dated July 6, 1995, shall be completed. 7. The setback requirements for the homes <br />and septic systems shall conform to the shoreland regulations. 8. An access permit from <br />Washington County shall be submitted to the City before final plat approval. 9. No construction <br />permits shall be issued for the project until all property to be added to the existing properties in <br />Beu-Haven has been transferred and recorded with the County. Motion passed 4-0. <br />D. PUBLIC HEARING: Case No. W95-25 A variance to the sign ordinance for placement of <br />a projecting sign. Applicant: John Schiltz/Lake Elmo Inn <br />John Schiltz, Lake Elmo Inn applied to the City for a variance to the sign ordinance. The public <br />hearing notice was published in the July 20, 1995, Stillwater Gazette, and all residents within 350 <br />feet were notified. The request proposes a 4.5 sq. ft. projecting sign placed 12 feet above the re- <br />located entrance to the Lake Elmo Inn. The face of the entrance structure, where the sign will <br />project from, is 32 inches to the edge of the curb. The sign ordinance requires that projecting <br />signs be setback 2 feet (24 inches) from the curb line. The sign width is 22 inches, and a sign <br />bracket (unspecified width) will be necessary to hold the sign. Washington County found it <br />unacceptable to project a sign into the street area, however, accepted the idea of the sign being <br />flush with the street or curb (letter from Joe Lux, dated July 24, 1995). The bracket and sign will <br />not protrude into the street area. The finished sign was shown to the council. <br />Mayor John opened the public hearing at 10:15 p.m. <br />A letter, dated July 21, 1995, from Dave Herreid, 3476 Lake Elmo Ave., stating support for the <br />variance and sign, was read into the record. <br />Kathy Weeks, 3647 Lake Elmo Ave., asked if the existing projecting sign on the sidewalk level <br />would be removed. Mr. Schiltz replied yes it will be removed and not replaced in that location, as <br />this sign will be its replacement. <br />
