LAKE ELMO CITY COUNCIL MEETING FEBRUARY 20, 1996 <br />M/S/P Hunt/Johnston - to direct the City Engineer to attend the SWWD meeting on Thursday, February <br />22, 7:00 p.m., at the Woodbury Public Works Building and comment on their proposed plans concerning <br />Lake Elmo's reservations of the scope of project and the fairness in the funding formulas. (Motion <br />passed 5-0). <br />Bohrer felt that Oakdale, as a municipality, would have the same concerns as Lake Elmo, such as, the <br />requirement to restrict flowrates below pre-existing rates and the funding formula to pay for this plan. <br />M/S/P John/Hunt - to direct the City Administrator to contact the Oakdale City Administrator with a view <br />to provide a united front on this subject. (Motion passed 5-0). <br />B. Developer's request for cluster drainfield assistance <br />Larry Bohrer was contacted by a developer, who would like to develop his land under the new cluster <br />regulations, inquiring if he could hire TKDA to design a cluster drainfield system. Bohrer explained that, <br />generally, TKDA is in a review and approval position on subdivisions, developments, etc. and would not <br />work for developers and the City at the same time. TKDA would be in a position of reviewing and <br />recommending approval of their own work. The Council asked that Larry Bohrer inform the developer <br />there was discussion at the council level and the council reaffirmed the general policy that the City <br />consulting engineer shall not work directly for developers. If a developer would like to petition for a <br />particular improvement as a City Improvement, then the City Council would deal with that on a case by <br />case basis whether they want to accept that petition as a City improvement. <br />C. Olson Lake Estates Pond Outlet Project:Valley Branch Watershed District <br />Larry Bohrer received a faxed letter from Randy Peterson, Barr Engineering, indicating the contractor <br />selected for the Olson Lake Estates Pond Outlet Project has requested to move construction equipment <br />and material into Pebble Park late this week or early next week. This equipment is expected to include 2 <br />backhoes, a front end loader, and pipe and related materials necessary for construction of the proposed <br />pipeline through Pebble Park. Since the posting of weight restrictions is expected to occur March 4, <br />1996, Barr Eng. is requesting permission from the City to begin moving equipment and materials into <br />Pebble Park. A schedule was provided showing construction beginning the week of March 18, 1996 <br />starting with the pipeline through Pebble Park. Bohrer and Maintenance Foreman Dan Olinger will attend <br />the pre -construction meeting for this project scheduled for March 5, 1996. Barr Eng. is requesting a <br />neighborhood meeting prior to March 18th to give the affected residents on Lake Jane Trail the <br />opportunity to ask questions regarding the project. <br />The Council has not seen the detailed plans and specs of the Olson Lake Estates Pond Outlet Project. <br />Therefore, the City engineer was asked to invite Randy Peterson to attend the next Council meeting to <br />present the plan for the outlet project. <br />M/S/P HunUDeLapp - to approve Barr Engineering's request for their contractor to move construction <br />equipment and materials into Pebble Park this week or early next week as long as an agreement is <br />entered into between the City and contractor which is acceptable to the City Engineer, Attorney and <br />Administrator, addressing restoration of Pebble Park immediately upon completion of the pipeline through <br />the park, the equipment and materials may use the park only until the site is completed through the park <br />and that the related equipment shall not interfere with the City's use of the ballfield, including the parking <br />lot. (Motion passed 5-0). <br />D. Section 33 Utility Project Proposed Lake Elmo/Oakdale Joint Powers Agreement <br />Larry Bohrer reported the plans are near the point where he would like to bring in a set for preliminary <br />review by the council. Because there is some involvement with the City of Oakdale, a Joint Powers <br />Agreement needs to be drafted which will cover such issues as purchase of water from Oakdale, joint use <br />
