LAKE ELMO CITY COUNCIL MINUTES APRIL 16, 1996 4 <br />C. Ordinance 8132 amending the Zoning District Map from Rural Residential to Public Facility <br />M/S/P Hunt/John - to adopt Ordinance 8132 amending the Lake Elmo Zoning Code based on the findings <br />in the Planning Review, Case No. ZAM/96-1 dated February 20, 1996; conditioned upon favorable <br />determination by the Metropolitan Council on the Future Land Use Map amendment, a favorable <br />determination by the appellate court in the matter of the lawsuit concerning this matter, and successful <br />closing on the property with the Berschens. (Motion passed 4-1:Conlin). <br />Administrator Kueffner pointed out the residents proposed changes to the Public Facility Zoning <br />Ordinance and these changes warranted review by the Planning Commission for a recommendation to <br />the City Council. <br />M/S/P Hunt/DeLapp - that the Planning Commission be directed to review the Public Facility Zoning <br />District with respect to its possible lack of similarities to other zoning districts in terms of standards <br />including citizen's information from the April 2 meeting be submitted to the Planning Commission in this <br />matter. (Motion passed 5-0). <br />D. Assessment Policy <br />The Council reviewed and approved the draft public improvement and assessment policy which had been <br />reviewed by the City Engineer and City Attorney. <br />M/S/P Hunt/Johnston - to adopt the Public Improvement and Assessment Policy, as amended, (Page 3 <br />B.7....project if sixty .... Page 4. DELETE Item D.3.) and publish a summary. (Motion passed 5-0). <br />E. Agricultural Zoning District Uses <br />Administrator Kueffner reviewed uses allowed in the Agricultural zoning district and based on discussions <br />between the Ag Use Committee and property owners in the City that would like to either expand the <br />existing use of their property (Armstrong, Hammes, Emerson, Springborn and Hansen) or be permitted to <br />relocate an existing business. Four of these property owners own parcels of land along 1-94 freeway and <br />would be given a reasonable use of their land for an Interim period of time through the transitional zoning <br />she has proposed. Attorney Filla explained that reasonable use is not necessarily the most profitable use <br />of land. The City's position is that anybody who owns property currently has reasonable use of their land <br />under the City's development regulations. <br />Council member Johnston indicated if somebody wants to put up a commercial, industrial or business <br />application of land, they should be looking at zoning that parcel to that kind of use and not making it fit in <br />an Ag zoning when it is not an agricultural use. Council members indicated they did not want to change <br />the uses in the Ag Zoning District nor allow transition zoning or reinstate Alternate Ag Zoning. <br />M/S/P Conlin/Johnston - that the City not consider any changes to the permitted uses or uses permitted <br />by CUP in the Ag zoning district to be expanded. (Motion passed 5-0). <br />M/S/P Conlin/Johnston - to direct the Planning Commission to take action on the Armstrong application. <br />(Motion passed 5-0). <br />F. Clean-up Day <br />Administrator Kueffnor reported that the City of Oakdale does not limit clean-up day to their own <br />residents. Lake Elmo residents are welcome to use the Oakdale clean-up date of April 27, 1996. Both <br />West Lakeland Township and Baytown Township have their clean-up day at the Washington County <br />
