LAKE ELMO CITY COUNCIL MINUTES APRIL 16, 1996 <br />M/S/P Hunt/DeLapp - to adopt Ordinance 8133, as amended, (Page 4, Item 11. Insert "letter of credit" in <br />place of "bond") An Ordinance adding Section 502.050 Excavating and Grading to the 1979 Lake Elmo <br />Municipal Code. (Motion passed 5-0). <br />B. PR96-11 Site and Plan Review - River Valley Church <br />This is a site and plan review for modifications to a previously approved plan for River Valley Christian <br />Church. The Planning Commission approved the plan at their April 8,1996 meeting with the (7) <br />conditions presented in the City Planner's review dated April 16, 1996. The Council received a letter from <br />Don Rolf, The Architectural network Inc. addressing the conditions of approval dated April 16, 1996. <br />M/S/P Hunt/Conlin - to approve Case No. PR/96-11 Site and Plan Review for the River Valley Church as <br />conditioned in the City Planner's review dated April 16, 1996 and amended by adding Condition #8. A <br />maximum sign height of 6 feet with a maximum face of 32 sq.ft. as recommended by the City Planner. <br />(Motion passed 5-0). <br />C. Request for Fence between Torre Pines Armstrong common lot line <br />The City received a request from Thomas Armstrong for a fence along the common lot line of his property <br />and Torre Pines and a letter from Attorney Filla explaining the procedures the City should follow and the <br />Statutes that govern this request. The City Attorney suggested the Council set a date for an on -site visit <br />to the property. <br />M/S/P Johnston/DeLapp - to set May 1, 1996 at 7:00 p.m. to meet at the entrance of Torre Pines to view <br />the common border of Torre Pines and the Armstrong Property to determine if a fence is appropriate and <br />if so what kind of fence. (Motion passed 5-0). <br />D. Comp. Plan/Open Space Development Update (Continued) <br />Administrator Kueffner reported the City Planner has recommended that the Council direct the Planning <br />Commission to hold a public hearing on May 8, 1996 on the Open Space Development Ordinance, <br />Comprehensive Plan Amendment, and review the moratorium to decide whether to allow it to terminate or <br />extend it for a length of time. Larry Bohrer agreed with the statements made by the City Planner on her <br />cover letter, that there are three major issues that have not been resolved yet; the overall densities, <br />minimum lot size, and septic system issue. <br />M/S/P Hunt/John - that the City publish the public hearing notice for a special Planning Commission <br />meeting for May 8, 1996 at 7 p.m. for a public hearing on the Comprehensive Plan Amendment and <br />adoption of the Agriculture/Open Space Preservation and Development Overlay District Ordinance and <br />review of the Development Moratorium. (Motion passed 5-0). <br />9. CITY ATTORNEY'S REPORT: <br />Attorney Filla reported we have received an agreement signed by Sue Sampson which will require the <br />City's signature and then this lawsuit has been resolved. <br />10. CITY COUNCIL REPORTS: <br />Councilman Hunt reported that at the March MAC meeting they have developed a system for requesting <br />work to be done. A Work Information Request will be drafted which will be filled out by the MAC Chair <br />and submitted to the City Administrator for distribution to the staff. <br />
