MAR-15-1996 16:45 TKDR 612 292 0083 P.03i15 AGREEMENT FOR WATER SERVICE between the CITY OF OAKDALE, MINNESOTA and CITY OF LAKE ELMO, MINNESOTA THIS AGREEMENT made and entered into this day of April, 1996, by and between the City of Oakdale, a municipal corporation located in Washington County, Minnesota, hereinafter called "Oakdale" and the City of Lake Elmo, a municipal corporation located in Washington County, Minnesota, hereinafter called "Lake Elmo". IJ!ll4�L-(��Y44i9 WHEREAS, the parties to this agreement entered into an agreement on February 14, 1995, whereby Lake Elmo agreed to investigate the feasibility of purchasing water from Oakdale — in order to provide service to the SE 1/4 of Section 33; and WHEREAS, a letter report from Progressive Consulting Engineers, Inc, to Oakdale dated April 3, 1995 showed that it is feasible to extend water service to the SE 114 of Section 33, NOW THEREFORE, the parties in consideration of the mutual covenants and agreements hereinafter set forth, have agreed to and with each other as follows: 0Ycli��'Ci1�r: yt This contract shall be for the term of 30 years from the date of execution hereof unless terminated earlier as hereinafter provided. This contract may be cancelled pursuant to Section l 1 or may be cancelled by either party if laws are enacted by the State of Minnesota or the United States of America which substantially and/or adversely affect rights, duties or obligations of either party under this contract. A, Oakdale agrees to furnish and deliver to Lake Elmo from the water system of Oakdale, the water requirements and fire protection requirements for general business uses. The service area is the SE 1/4 of Section 33, Township 29, Range 21.
