MAR-15-1996 16:45 TKDR 612 292 0083 P.03i15 <br />AGREEMENT FOR WATER SERVICE <br />between the <br />CITY OF OAKDALE, MINNESOTA <br />and <br />CITY OF LAKE ELMO, MINNESOTA <br />THIS AGREEMENT made and entered into this day of April, 1996, by and <br />between the City of Oakdale, a municipal corporation located in Washington County, Minnesota, <br />hereinafter called "Oakdale" and the City of Lake Elmo, a municipal corporation located in <br />Washington County, Minnesota, hereinafter called "Lake Elmo". <br />IJ!ll4�L-(��Y44i9 <br />WHEREAS, the parties to this agreement entered into an agreement on February 14, <br />1995, whereby Lake Elmo agreed to investigate the feasibility of purchasing water from Oakdale <br />— in order to provide service to the SE 1/4 of Section 33; and <br />WHEREAS, a letter report from Progressive Consulting Engineers, Inc, to Oakdale dated <br />April 3, 1995 showed that it is feasible to extend water service to the SE 114 of Section 33, <br />NOW THEREFORE, the parties in consideration of the mutual covenants and agreements <br />hereinafter set forth, have agreed to and with each other as follows: <br />0Ycli��'Ci1�r: yt <br />This contract shall be for the term of 30 years from the date of execution hereof <br />unless terminated earlier as hereinafter provided. This contract may be cancelled <br />pursuant to Section l 1 or may be cancelled by either party if laws are enacted by <br />the State of Minnesota or the United States of America which substantially <br />and/or adversely affect rights, duties or obligations of either party under this <br />contract. <br />A, Oakdale agrees to furnish and deliver to Lake Elmo from the water system <br />of Oakdale, the water requirements and fire protection requirements for general business uses. <br />The service area is the SE 1/4 of Section 33, Township 29, Range 21. <br />
