MAP-15-1996 16:48 TKDA 612 292 0003 P.09i15 <br />JOINT POWERS AGREEMENT <br />BETWEEN THE CITY OF OAKDALE l <br />AND THE CITY OF LAKE ELMO <br />WITHIN OAKDALE CITY PROJECT NO.95.10 <br />THIS AGREEMENT made and entered into this day of April, 1996, by and <br />between the City of Oakdale, a municipal corporation located in Washington County, Minnesota, <br />hereinafter called "Oakdale" and the City of Lake Elmo, a municipal corporation located in <br />Washington County, Minnesota, hereinafter called "Lake Ehno". <br />WTTNESSETH: <br />WHEREAS, Lake Elmo desires sanitary sewer service to the SE 1/4 of Section 33, <br />Towns;hip 29, Range 21, and <br />WHEREAS, Lake Elmo does not have access to a metropolitan interceptor sewer within <br />its municipal boundaries, and <br />WHEREAS, Lake Elmo and Oakdale have entered into an agreement dated February 14, <br />1995 which, in pan, states that both cities will study the joint and/or parallel construction of <br />sanitary sewer facilities, and <br />WHEREAS, both cities have now conducted feasibility studies and public hearings for <br />the installation of these joint and/or parallel sanitary sewer facilities. <br />NOW THEREFORE, the parties in consideration of the mutual covenants and agreements <br />hereinafter set forth, have agreed to and with each other as follows: <br />ri • 9.i. ' <br />This contract shall be perpetual from the date of execution hereof unless <br />terminated earlier as hereinafter provided. This contract may be cancelled pursuant to Section _ <br />or may be cancelled by either party if laws are enacted by the State of Minnesota or the United <br />States of America which substantially and/or adversely affect rights, duties or obligations of <br />either party under this contract. <br />-1- <br />
