SAAIITARYSEWER FORCEM <br />Oakdale shall contract for and construct under Oakdale City Project No. 95-10 <br />an 8-inch diameter sanitary sewer forcemain in the south boulevard of the I-94 North Frontage <br />Road (a,k.a. Hudson Boulevard) from Guardian Angels Drive to a point approximately 1352 feet <br />west of Ideal Avenue. This forcemain is for the sole use and benefit of Lake Elmo. The cost of <br />this forcemain work, including construction, inspection, and staking, shall be paid for by Lake <br />Elmo to Oakdale in accordance with Exhibit A attached hereto. <br />Oakdale shall contract for and construct under Oakdale City Project No. 95-10 a <br />10-inch diameter gravity sanitary sewer in the I-94 North Frontage Road (a k.a. Hudson <br />Boulevard) from the W.O.N.E, interceptor to a point approximately 1,109 ;Feet cast. This gravity <br />sanitary sewer is for the joint use and benefit of both cities. The nse and benefit to Oakdale is <br />lateral sanitary sewer service to abutting property. The use and benefit to Lake Elmo is outfall <br />service for the forcemain described in paragraph 2 above. The cost of this joint gravity sanitary <br />;sewer work, including construction, inspection, and staking shalt be shared by both cities in <br />accordance with Exhibit B attached hereto. <br />' ' • �1' ►M. <br />Lake Elmo shall pay to Oakdale 95% of the costs provided in Exhibits A and B <br />at the. time Oakdale awards a construction contract for City Project No. 95-10, Lake Elmo shall <br />pay to Oakdale the remainder of the costs provided in Exhibits A and B, subject to any change <br />orders for those portions of the work, at the time Oakdale issues final payment for City Project <br />No. 95-10. <br />lake Elmo shall assume full responsibility for the maintenance of the sanitary <br />sewer forcemain constructed under City Project No, 95-10. Should said maintenance cause or <br />require the repair of surface improvements, said surface improvements will be restored equal to <br />or better than present conditions. <br />� u e urr. s . • .rr ,�� .. w,..-,. <br />Lake Ehno and Oakdale shall share in the maintenance of the joint use gravity <br />sanitary sewer described in paragraph 3 above.
