LAKE ELMO CITY COUNCIL MINUTES MAY 7, 1996 4 <br />neither VBWD or the contractor gave notification to residents or the school districts that the road was <br />going to be to blocked. The generator used to power the pump to remove the water was causing the <br />house opposite the generator to resonate and the houseowner hadn't been able to sleep for a number of <br />days. Councilors Hunt and DeLapp received reports from the public that as the contractor is backfilling, <br />this site is not being compacted and they have settling concerns. Driveways are also being blocked. <br />Larry Bohrer will look into this and if he has to put an inspector out there to insure the integrity of the <br />City's road he will. Public notification and City communication have not been set up the way it was <br />explained in the beginning preconstruction meeting. Randy Peterson is considering taking some of the <br />responsibility away from the contractor and dropping off a form letter at the homes notifying the resident <br />that the following day the driveway will be restricted. Members, Hunt and DeLapp, remembered the <br />- — - statement made at a meeting that one lane on Lake Jane was to be open at all times for traffic to get <br />through and this has not been done. <br />M/S/P John/Hunt - to instruct TKDA to have an inspector out on the Olson Lake Estates Outlet Project to <br />insure the City's interest of the integrity of Lake Jane Trail and this will be a pass -through cost to the <br />VBWD. (Motion passed 5-0). <br />5. CONSENT AGENDA <br />A. Recommendation from Planning Commission on Armstrong request for CUP Amendment <br />Tom and Jodi Armstrong have asked that this item be tabled until the May 21, 1996 meeting as they have <br />an extensive tree planting schedule to meet. <br />M/S/P Johnston/Hunt - at the request of the property owners, Council action on the Armstrong request for <br />a Conditional Use Permit amendment shall be tabled until the May 21, 1996 meeting. (Motion passed 5- <br />0). <br />B. Response from City Council following its on -site visit to the Armstrong/Torre Pines property <br />regarding Armstrong's request for a fence along the common lot line. <br />Tom and Jodi Armstrong have asked that this item be tabled until the May 21, 1996 meeting as they have <br />an extensive tree planting schedule to meet. <br />M/S/P Johnston/Hunt - at the request of the property owners, Council action on the Armstrong request for <br />a fence along their common lot line with Torre Pines shall be postponed until the May 21, 1996 meeting. <br />(Motion passed 5-0). <br />C. On Sale Non -Intoxicating Malt Liquor License for Cimarron Pro -Shop <br />The Pro -Shop, Cimarron Golf Course, has applied for renewal of their Non -intoxicating malt liquor "on - <br />sale" license. A certificate of insurance has been submitted and the fee has been paid. <br />M/S/P Johnston/Hunt - to grant an On -Sale Non -Intoxicating Malt Liquor License to the Pro Shop of the <br />Cimarron Golf Course contingent upon approval by the Washington County Sheriff's Department. <br />(Motion passed 5-0). <br />6. CITY ENGINEER'S REPORT <br />A. CSAH 13 Reconstruction (Amendment to City's Cost) <br />Washington County has received bids on the County Road 13 Reconstruction project. There was an <br />increase of over $900 for the City's portion of the project. Our agreement with the County requires City <br />approval of that increase. <br />
