City of Lake Elmo <br />Public Improvements and Assessment Policy <br />- D. Benefit Appraisal: Usedwhenproperty owners within thebenefitingarea indicate <br />none of the above noted methods appear appropriate. <br />Corner Lots: Corner lots are included in the benefiting area with the exception of single/two <br />family dwellings. If the improvements are along the front lot line of a single/two family <br />dwelling, the parcel shall be included in the benefiting area with each unit assessed separately. If <br />the improvements are along the side lot line of a single/two family dwelling, the parcel shall not <br />be included in the benefiting area, unless the lot can be subdivided. <br />Recreational Lots: Recreational lots without a primary living structure, but used for <br />recreational purposes, and not combined with the owners' lot with a primary structure shall be <br />included in the benefiting area. <br />- Agricultural and Rural Residential Property: _-Property zoned Agricultural or Rural <br />Residential that has not been subdivided, or is in the Green Acres program will be assessed as <br />one unit for each dwelling on the property. If the property is subdivided after the completion of <br />said improvement, but before the expiration of the assessment period or eight years, whichever is the greater, then the property will pay a total contribution equivalent to the total number of <br />subdivided lots. <br />IV. IMPROVEMENTS <br />A. Roadway and Signal Improvements <br />1. Petitions for roadway and street lighting projects shall be filed and accepted by the <br />Council prior to January 1 of the year of construction. The Council may authorize <br />accepting a petition after January by special consent. <br />2. Projects are initiated by petition of thirty-five (35) percent of the property owners <br />measured in area and/or frontage or by a majority vote of the City Council for <br />roadway improvements. <br />3. Projects initiated by a property owner shall require the property owner to allow <br />assessment of all project costs or if City participation is appropriate, the City's <br />share shall be outlined in a Developers Agreement. <br />4. Street light petitioned projects shall be accumulated and authorized as one (1) <br />project. The costs shall be uniformly spread to the benefiting properties. <br />5. the method of assessment can be any method described in Section III. <br />B. Reconstruction <br />1. Petitions for roadway projects shall be filed and accepted by the Council prior to <br />January 1 of the year of construction. The Council may authorize accepting a <br />petition after January 1 by special consent. <br />2. The scope of project shall be determined by traffic volumes, and reason for <br />pavement deterioration. <br />
