LAKE ELMO CITY COUNCIL MINUTES JUNE 18, 1996 <br />M/S/P Hunt/Johnston - to adopt Resolution No. 96-12, A Resolution ordering the Improvement of CSAH <br />13 (Inwood Avenue) from CSAH 6 (Stillwater Blvd.) to CSAH 10 in accordance with plans as presented <br />by the Washington County Public Works Dept. (Motion passed 5-0). <br />6. PLANNING/LAND USE & ZONING: <br />A. Case No. V/96-14, Variance to lot width: Mike Severin, 8012 50th St. (Continued) <br />As directed by Council, the staff has reviewed additional background regarding the Meier property and <br />the Severin property. On June 6, 1989, the Council postponed consideration to deny a variance request <br />to lot size and frontage for Mrs. Meier's property. It was also stated that a building would be a disruption <br />to the adjoining property owners. <br />City Planner Terwedo reported the south parcel should not be considered a buildable lot, but it does <br />seem reasonable to allow an accessory structure on the lot. A restrictive convenant should be placed on <br />this south parcel which would only allow an accessory structure and would tie the two parcels together. <br />Terwedo recommended that Bennett Street not be vacated at this time. Mrs. Meier was invited to meet <br />with the City Planner and Administrator to discuss what could be done with her lot. <br />M/S/P Hunt/DeLapp - to approve Case No. V/96-14, Variance to lot width to Mike Severin, 8012 <br />50th St., with the conditions, as amended (#3 Delete second sentence. Add:fence placed on the crest <br />near the north property line, #4 Before issuance of building permit a restrictive convenant shall be placed <br />on the lot and filed with Washington County.) and based on findings of Case Review dated 6-18-96. <br />(Motion passed 5-0). <br />B. PUBLIC HEARING: Cased No. WGP/96-19: Request for Wind Generator Permit <br />Applicant:George Dege <br />The Public hearing notice was published in the Stillwater Gazette and the property owners within 350' <br />were notified. <br />George Dege, 5193 Keats Avenue N., is requesting approval of a Wind Generator Permit in order to <br />place a wind generator, 85 feet in height, on a parcel over 40 aces. The setbacks meet the requirements <br />for the district. No fencing or lighting is proposed. The wind generator is gray in color and has a red light <br />on the top. The area is not in the airport safety zone and no other wind generator is located within 1000 <br />feet. Mr. Dege corrected the dimension from 380' to 280' from the adjacent property as shown on Figure <br />5. <br />Mayor John opened up the public hearing at 8:50 p.m. <br />There was no one to speak for or against the Wind Generator Permit request <br />Mayor John closed the public hearing at 8:53 p.m.. <br />M/S/P Johnston/DeLapp - to approve the Wind Generator Permit for George Dege, 5193 Keats Avenue <br />N., subject to 1. The City Engineer shall inspect the structure and approve it structural safety for a <br />building permit, 2. This permit is non -transferable and 3. All other conditions in Section 1105.01 through <br />1105.06 shall be met. (Motion passed 5-0). <br />C. PUBLIC HEARING: Case No. CUPN/96-7:CUP & Variance to minimum LB District requirements, <br />Applicant:Walter Pechan <br />This item was deleted from the agenda. The public hearing for the CUP is scheduled for the July 8, 1996 <br />Planning Commission meeting and the public hearing for the variance request is scheduled for the July <br />16, 1996 City Council meeting. <br />
