LAKE ELMO CITY COUNCIL MINUTES JULY 2, 1996 4 <br />Karin Schubert, 5222 Keats Avenue N., said she was stunned that the City would even consider the <br />changes proposed to the ordinance. She said now the ordinance permits construction work 11 hours a <br />day, 7 a.m. to 6 p.m., The new ordinance the City is proposing would allow 13 hours a work day. After <br />listening to the beep of construction equipment for hours on the Arabian Hills Subdivision, she had to run <br />away from home to get peace and quiet. She lost three summers because of the annoying noises from <br />construction. Special permission should be granted individually for emergency work and not adopt a <br />blanket ordinance such as this. She does not believe it is an emergency for a developer to have <br />equipment working longer hours, weekends, and holidays. <br />Dick Johnson, 8896 Lake Jane Trail, pointed out the ordinance now allows for emergency situations as <br />long as they follow the procedure. With the new ordinance, the City is going to allow anyone to work <br />seven days a week and holidays. He objects to this ordinance for the same reasons Karin Schubert had <br />stated. Noise is damaging to the residents. We live here, we're taxpayers, and don't have to put up with <br />it and objects to us bending over backwards for contractors. You are my elected Council and we deserve <br />better treatment. <br />Rose Armstrong, 8281 15th St., stated on Monday at 5:30 a.m. she was awakened by gunshots in her <br />neighborhood The neighbor told her the ordinance allows him to fire a gun at 5:30 a.m. This is noise <br />pollution. <br />Sue Dunn stated she had never seen anything as broad as this. She did not get the mailing, but picked it <br />up tonight. It must have been extremely expensive to mail the public hearing notice to the entire City. <br />The hours the ordinance allows now are adequate and the Council should think about the people that live <br />here. <br />The Council received letters opposing the amendment to Section 1607.030 by Daniel Rude, 3250 Kraft <br />Circle N., Roger & Gayle Pawlus, 8699 Lake Jane Trail; Patricia Ganley, 8975 N. 15th St.; Joan <br />Hjelmgren and a phone call from Mr. Jenings. <br />Mayor John closed the public hearing at 8:18 p.m. <br />Steve DeLapp felt the one thing that we owe the voters that put them here is the best possible living <br />environment. This doesn't mean having a developer making money on a development or somebody with <br />an understaffed crew work longer hours and weekdays. A copy of our ordinances should be given to the <br />contractors when they start to work in our City. Emergency situations can be dealt with. <br />Attorney Filla was confident an ordinance could be drafted which incorporates a due process procedure <br />and redefine definition for economic loss which would deal with concerns. The ordinance does not give <br />any direction how to go about applying standards to determine there is an emergency or economic loss. <br />M/S/P Johnston/DeLapp - to direct the staff and City Attorney to revise the existing ordinance to include <br />such items as definition for "emergency situation" , "determination of substantial economic loss to a <br />person...", standards by which applications for permits can be judged and specific language as to who <br />can authorize a special permit and any other language added in order to make this ordinance <br />understandable. (Motion passed 3-0). <br />5. FINANCE DEPARTMENT: <br />A. Resolution authorizing issuance and sale of $650,000 General Obligation Temporary Improvement <br />Bonds, Series 1996A <br />The Council received a copy of (1) a Certification of Minutes Relating to $650,000 General Obligation <br />Temporary Improvement Bonds, Series 1996A; (2) Resolution authorizing Issuance and Sale of $650,000 <br />General Obligation Temporary Improvement Bonds, Series 1996A; and (3) the terms of Proposals. This <br />GO Bond is for the new sewer installation in the portion of Section 33 now in the.MUSA. <br />
