LAKE ELMO CITY COUNCIL MINUTES SEPTEMBER 17, 1996 <br />Mayor John called the Council meeting to order at 7:06 p.m. in the Council chambers. PRESENT: <br />DeLapp, Hunt, John, Conlin, Johnston, City Engineer Tom Prew, City Attorney Jerry Fills, City Planner <br />Terwedo and Administrator Kueffner. <br />1. AGENDA <br />ADD: 7B. Tree Trimming, 8D. Discuss Task Force role with maintenance plan <br />WS/P DeLapp/Hunt - to approve the September 17,1996 City Council agenda as amended. (Motion <br />passed 5-0). <br />2. MINUTES: September 3, 1996 <br />M/S/P Conlin/DeLapp - to approve the September 3,1996 City Council minutes as amended. (Motion <br />passed 5-0). <br />3. CLAIMS <br />M/S/P Johnston/Conlin -to approve the September 17, 1996 Claims #5111 trough #5153 as presented. <br />(Motion passed 5-0). <br />4. PUBLIC INFORMATIONAL: <br />A. Suburban Rate Authority Membership <br />Jim Strommen, legal counsel to the SRA, stated the Suburban Rate Authority is offering Lake Elmo <br />membership in the organization through June 30, 1997 for no annual assessment or continued obligation <br />of any kind. The SRA has been an effective voice for suburban metropolitan area cities and residents, as <br />a regulatory body from• 1962 through 1974 and as an intervenor in gas, electricity, and telecommunication <br />matters from 1975 to present. The SRA is requesting a representative of the City; such as someone from <br />the Public Works or Finance Department, as its member on the Board of the Suburban Rate Authority. <br />M/S/P Hunt/DeLapp - to adopt Resolution No. 96-28 authorizing Lake Elmo's participation in the <br />Suburban Rate Authority through June 30, 1997; and in the future will designate a member for the Board <br />of the Suburban Rate Authority; further that the staff place this item on the agenda for the first meeting of <br />June, 1997 for Council to review this program to consider permanent membership. (Motion passed 4- <br />1:Conlin) <br />B. Resolution Authorizing the Transfer of Cable Franchise <br />Robert Vose, legal counsel for RWCC, explained the two resolutions provided; the first consenting to the <br />transfer of control and certain ownership interests in a cable television franchise to Continental, and the <br />second for consenting to the transfer of control and certain ownership interest in a cable television <br />franchise to U.S. West. <br />M/S/P Conlin/DeLapp - to adopt Resolution No. 96-29 consenting to the transfer of control of and certain <br />ownership interests in a cable television franchise to Continental. (Motion passed 5-0). <br />M/S/P Conlin/Johnston - to adopt Resolution No. 96-30 consenting to the transfer of control of and certain <br />ownership interests in a cable television franchise to U.S. West. (Motion passed 5-0). <br />C. Tree Trimming <br />Although it is in our ordinance that the City has a right to tree trim in the right-of-way for safety reasons, <br />Council member Conlin felt it would be more sensitive If the City had a tree trimming plan notifying the <br />residents in advance giving them an opportunity of removing smaller plantings to another area on their <br />property. <br />
