LAKE ELMO CITY COUNCIL MINUTES OCTOBER 15, 1996 <br />It was George Burkard, United Properties, understanding that the assessment for Northland Land Co. <br />would be spread over 15 years and in all likelihood they hope to get the area developed and pay as they <br />go. Therefore, with the Finance Director's recommendation, the Administrator prepared Resolution 96-33 <br />to extend the assessment 15 years versus 10 years. <br />Mayor John opened up the public hearing at 7:35 p.m. for Parcels 37033-2000, 2055 and 2200. <br />There was no one in attendance to speak for or against the proposed assessments. <br />Mayor John closed the public hearing at 7:40 p.m. <br />Attorney Filla suggested approval of Resolution No. 96-33A for parcels 37033-2025, 2050; subject to the <br />receipt of Acknowledgment and Waiver of Defects from property owners Goss and Kopeski by Noon on <br />October 16th or in the alternative conduct a public hearing on these parcels for which the waiver notices <br />have not been received on October 30, 1996 at 5:30 p.m. <br />M/S/P Johnston/Hunt - to adopt Resolution No. 96-33, as modified, Paragraph #1 "such proposed <br />assessment as it relates to Parcel No. 37033-2000, 2055 and 2200 a copy of which is attached". (Motion <br />passed 4-0). <br />M/S/P Johnston/Hunt - to adopt Resolution No. 96-33A, Paragraph #1 as it relates to the two parcels <br />such proposed assessment as it relates to Parcel 37033-2025 and 2050 subject to a receipt of <br />Acknowledgment and Waiver of Defects no later than Noon on October 16th OR in the alternative if the <br />waiver notices are not received by that time then republish and remail notice to affected property owners <br />(37033-2025 Goss, 37033-2050 Kopeski) to conduct a public hearing on October 30, 1996, 5:30 p.m. <br />(Motion passed 4-0). <br />B. Paving shoulders on Olson Lake Trail (Update) <br />At the October 1 at meeting, the City Engineer was asked to check on the status of the shoulder paving <br />on Olson Lake Trail. Tom Prew reported that the shoulders were paved this week and VBWD approved <br />reinstalling the trees that were removed. <br />C. Escrow Reduction Lake Elmo Heights 3rd Addition <br />Tom Prew reported in his memo dated October 10, 1996 that the developers of Lake Elmo Heights 3rd <br />Addition have requested a reduction in their security deposit. The following work remains to be <br />completed. <br />Landscaping and Erosion Control $10,000.00 <br />Administration and Inspection 2,000.00 <br />+25% By Ordinance 3,000.00 <br />Required Escrow $15,000.00 <br />Bob Helwig had informed the City that completion of the landscaping has not been done on the yards <br />where there was the removal of the cul-de-sac. Tom Prew responded that the $10,000 held in escrow <br />will cover this landscaping. Filla suggested the Council take this action subject to extension of letter of <br />credit to cover any landscaping/trees beyond the Fall. <br />M/S/P Conlin/Johnston - to reduce the required escrow for Lake Elmo Heights 3rd Addition to <br />$15,000.00 and the developer shall pay outstanding City costs incurred to date based on the <br />recommendation of the City Engineer; subject to extension of letter of credit into the Spring to cover any <br />landscaping/trees planted in the Fall. (Motion passed 4-0). <br />
