LAKE ELMO CITY COUNCIL MINUTES NOVEMBER 7, 1996 <br />C. Ordinance amending Section 700 of Lake Elmo Municipal Code <br />The Council previously adopted the revision of Section 700 of the Municipal Code as recommended by <br />the City Engineer. When the Council did approve this revision, it was not in ordinance form. The City <br />Administrator prepared the appropriate ordinance as well as a summary ordinance for publication. <br />M/S/P Johnston/Hunt - to adopt Ordinance 8146, Ordinance amending Section 700 of the Lake Elmo <br />Municipal Code, but to delay adoption of Summary Ordinance to the November 19th council meeting <br />because the summary requires action from four Council members. (Motion passed 3-0). <br />D. Street Light Request from Christ Lutheran Church <br />The City received a letter from Judy Toft, a member of the property board at Christ Lutheran Church, <br />requesting street lights be installed at the Church's entrance off 36th Street and at the church entrance <br />off Laverne Avenue. In the past the Council has referred these types of requests to the City Engineer to <br />see if the existing utility poles can accommodate the requested lighting, if there will be an installation <br />charge, and what the monthly charge will be for the lights. <br />M/S/P Hunt/Johnston - to direct the City Engineer to investigate the possibility of installing two street <br />lights, as requested by Christ Lutheran Church, and report back to the City Council at its November <br />19,1996 meeting with a response to this request. (Motion passed 3-0). <br />8. PLANNING, LAND USE & ZONING: <br />A. OP Concept Plan: Krieger Property (Jack Buxell) County Road 17 and 10 <br />Since four votes are needed for approval of a concept plan which does not meet the strict interpretation <br />of the open space preservation ordinance and there were only three Council members in attendance, the <br />following motion was made. <br />M/S/P Hunt/Johnston -to postpone consideration of recommendation of OP Concept Plan submitted by <br />Jack Buxell for the November 19, 1996 City Council meeting. (Motion passed 3-0). <br />B. Public Hearing: Vacation of Street Easement (8271 Lake Jane Trail ) <br />The public hearing notice was published in the October 25, 1996 Stillwater Gazette and affected property <br />owners were notified. <br />Planner Terwedo reported there is an identified 120' street easement which extends north and south <br />through Lot 16 of Three Lakes Farm Addition. The easement was identified in a title search of the <br />property. The 120' easement bisects the site. Since there are existing one acre homes to the south, it <br />would be difficult to extend a road through this property. There is a development agreement signed in <br />1984 and recorded at Washington County in 1985, designating this easement. On June 20, 1986, an <br />affidavit was prepared and signed by the city Administrator which describes the easement. <br />Mayor John opened up the public hearing at 8:25 p.m. <br />I <br />Vicki Bergstedt, Realty World, spoke in favor of the vacation request. <br />I <br />Mayor John closed the public hearing at 8:27 p.m. <br />M/S/P Hunt/Johnston - to adopt Resolution No. 96-36, A Resolution Vacating an Easement Over a <br />Portion of Lot 16, Three Lakes Farm Addition. (Motion passed 3-0). <br />
