LAKE ELMO CITY COUNCIL MINUTES DECEMBER 3, 1996 <br />Mayor John opened up the City Council meeting at 7:00 p.m. in the Council chambers. PRESENT: <br />DeLapp, John, Conlin, Johnston, City Engineer Prew, City Attorney Filla, Planner Terwedo and <br />Administrator Kueffner. ABSENT: Hunt <br />1. AGENDA <br />M/S/P Johnston/Conlin - to approve the December 3, 1996 City Council agenda as amended. (Motion <br />passed 4-0). <br />2. MINUTES; NOVEMBER 19, 1996 <br />M/S/P Johnston/Conlin -to approve the November 19,1996 City Council minutes as amended. (Motion <br />passed 4-0). <br />3. CLAIMS <br />M/S/P Johnston/Conlin - to approve the December 3,1996 Claims #5374 through #5417 as presented. <br />(Motion passed 4-0). <br />4. PUBLIC INFORMATIONAL: <br />A. Public Inquiries <br />John Duoma, Cimarron resident, reported that Cimarron Park raised their lot rent to $350 per month <br />effective January, 1997, and asked what can they do about this. Administrator Kueffner suggested they <br />invite Rep. Larsen and Senator Laidig to the next Cimarron Community Coalition meeting and request <br />language that could be presented in a form of a bill that would freeze the rent for people on limited <br />income. Lake Elmo does not have a contractual agreement with Chateau Properties who operates <br />Cimarron Park. <br />B. Snowmobile Trail Permit in MN/DOT Right-of-way <br />Sgt. Gary Swanson reported he is the Sergeant of the new unit the Sheriff has called Water Patrol Parks <br />and Trail. Swanson attended a meeting with the Administrator, Dan Olinger, Pete Schiltgen to come up <br />with a compromise with MN/DOT because they did not like the orange snowfencing installed along <br />Highway 5 right-of-way to direct snowmobile traffic. These snow fences and signs, which were also <br />installed last year, helped control the snowmobilers and kept the complaints down. Sgt. Swanson <br />provided the Council with a copy of a limited use permit from MN/DOTwhich is necessary for any trails in <br />State right-of-way and asked the City to apply for this permit. <br />M/S/P DeLapp/Conlin - to approve the Limited Use Permit with MN/DOT conditioned upon review and <br />approval by the City Attorney. (Motion passed 4-0). <br />6. CONSENT AGENDA: <br />A. 1997 Liquor Licenses <br />M/S/P Johnston/DeLapp - to grant the following 1997 Liquor and Beer Licenses; a Club -On Sale Liquor <br />License to the Veterans of Foreign Wars Post 5725, On -Sale and On -Sale Sunday Intoxicating Liquor <br />License to 3M Club of St.Paul (Operators of Tartan Park), On -Sale Intoxicating Liquor, Off -Sale <br />Intoxicating Liquor, and On -Sale Sunday Intoxicating Liquor License. (Motion passed 4-0). <br />B. One -Day Charitable Gambling License; School of the Transfiguration at the Lake Elmo Inn <br />M/S/P Johnston/DeLapp - to adopt Resolution No. 96-40, A Resolution approving the issuance of a One - <br />Day Charitable Gambling License by the State of Minnesota to the School of the Transfiguration at the <br />Lake Elmo Inn.
