E. Rezone from (RR) Rural Residential to (OP) Open Space Preservation District, TAMARACK <br />FARM <br />M/S/F DeLapp/Hunt — to adopt Ordinance No. 9704 (Motion failed 3-1:Conlin: there was no applicant <br />present and we didn't spend enough time as we had with the other applicants, Councilor Donn had stepped <br />out during the vote on this motion). <br />M/S/P Conlin/Hunt — to reopen the issue of the rezoning from RR to OP for Tamarack Farm. (Motion <br />passed 5-0). <br />M/S/P DeLapp/Hunt — to postpone request for rezoning until the applicant, Jon Whitcomb can attend the <br />Council meeting. (Motion passed 5.0). <br />M/S/P Hunt/DeLapp — to rescind the denial of the rezoning from RR to OP requested by Jon Whitcomb for <br />Tamarack Farm (Motion passed 5-0). <br />F. OF Development Concept Plan, John Whitcomb, TAMARACK FARM <br />The Council wanted to make an informed decision and to discuss the concept with the developer. <br />M/S/P DeLapp/Hunt — to postpone discussion on the Concept Plan for Tamarack Farm until the applicant, <br />Jon Whitcomb can attend the Council meeting. (Motion passed 5-0). <br />G. Amendment to Section 400.09 Final Plat, Subd. 2 & 3 <br />The Platting Section of the City Code, Section 400, has a requirement that final plats be approved by the <br />Planning Commission with recommendation to the City Council. The Open Space Ordinance requires that <br />the final plat be reviewed by the Council only —this is a conflict. Planner Terwedo explained in most <br />communities, final plats are reviewed and approved only by the Council since the final plat should reflect <br />the preliminary plat. If a final plat does not reflect the preliminary plat, it would need to be sent back to the <br />Planning Commission. The final plat is normally a formality. In the case of the OP developments, there <br />would be a throe -step process for review by the Planning Commission for any particular development. <br />M/S/P Hunt/DeLapp - to adopt Ordinance 9704, An Ordinance amending Section 400.09 Subdivision 2 <br />and Deleting Section 400.09 Subdivision 3 of the Lake Elmo Municipal Code relating to Final Plats. <br />(Motion passed 5-0). <br />9. CITY ATTORNEY'S REPORT:None <br />10. UNFMSHED BUSINESS: <br />A. Proposed road & bridge improvements:Request by City Council from 4-1-97 <br />Because of the late meeting time, this item was not discussed, Councilman DeLapp informed the Council <br />that County Road 5 is going to be a 4-lane highway from Stillwater to 5061 Street. <br />B. Recommendation on laser printer: Lee Hunt <br />Councilor Hunt is recommending the purchase of a HP Laser Jet 4 V Printer, which can print on 11 x 17 <br />paper, envelopes, and prints 16 pages a minutes, from GE -IT Capital Solutions (formerly Ameri-Data) who <br />has the purchasing contract for the State of Minnesota. The cost for the printer is $1,843 and comes with a <br />one-year warranty. Hunt also recommended the purchase of a memory up -grade at a cost of $198. <br />M/S/P ConliwDeLapp — to approve the purchase of a HP Laser Jet 4V Printer ($1,843) and memory up- <br />grade ($198) as recommended by Councilor Hunt plus tax and freight of $20 as supported by the City staff. <br />(Motion passed 5-0). <br />LAKE ELMO CITY COUNCIL MINUTES MAY 6, 1997 7 <br />
