Mayor John closed the public hearing at 9:11 p.m. M/S/P Dunn/DeLapp — to repeal Ordinance 9705 adopted by the Lake Elmo City Council on May 6,1997 (Motion passed 4-0). M/S/P Dunn/DeLapp — to adopt Ordinance No. 9710 extending the corporate limits of the City of Lake Elmo to include certain unincorporated territory abutting the City limits not exceeding sixty (60) acres upon petition for annexation from all of the property owners there of (Glen and Colleen Houle and Robert Engstrom) pursuant to Minnesota Statute 414.033 Subd. 2 (3). (Motion passed 4-0). F. Conditional Use Permit Review: Jim McNamara Jim McNamara provided a list of Conditional Use Permit holders in the City and gave a verbal report. Hammes Mining — in litigation Shafer Mining — Mr. Spicek has been notified of the ATV use and will put up more signs. The Sheriff Department is also aware of the problem. Armstrong — Count of 84 cars Jamie Olson — sign is within limits M/S/P DeLapp/John — to place a notice in the newsletter on ATV use not acceptable in the Shafer Mining pit. (Motion passed 4-0). 9. CITY ATTORNEY'S REPORT: Hammes Litigation (Executive Session) 10. UNFINISHED BUSINESS: A. Signs on Upper 33'd Street Councilor Dunn reported the maintenance crew were not putting up the signs where they were intended to go as described in the diagram proposed by Dan Olinger at the June 3`a meeting.. Dan Olinger will attend the next Council meeting and explain why he made the change. M/S/P John/Dunn — to direct the staff to send a letter to the Lake Elmo Inn emphasizing the parking problem and it is the intention of the City to prosecute violations and John Schultz draw this to the attention of his customers. The Planner offered to go out and check the number of signs. (Motion passed 4-0). 11. CITY COUNCIL REPORTS: Mayor John reported on the successful visit to the League of Minnesota Cities conference in St. Cloud. Councilor DeLapp provided an article on West Palm Beach. Councilor Dunn asked if the Fire Department could work with Mike Bouthilet in assistance with watering the trees being stressed by the drought. 12. CITY ADMINISTRATOR'S REPORT: A. 1996 Fire Department Annual Report Chief Sachs presented the Lake Elmo Fire Department's 1996 Annual Report. The Council commended him on a very well written readable report and thanked the Department for their efforts. B. Appeal Planning Commission recommendation on Case V/97-32, Brookman Motors Administrator Kueffner is appealing the decision of the Planning Commission to approve the variances requested by Brookman Motors at its June 9, 1997 meeting after reviewing the application and supporting data.
