Mayor John closed the public hearing at 9:11 p.m. <br />M/S/P Dunn/DeLapp — to repeal Ordinance 9705 adopted by the Lake Elmo City Council on May 6,1997 <br />(Motion passed 4-0). <br />M/S/P Dunn/DeLapp — to adopt Ordinance No. 9710 extending the corporate limits of the City of Lake <br />Elmo to include certain unincorporated territory abutting the City limits not exceeding sixty (60) acres upon <br />petition for annexation from all of the property owners there of (Glen and Colleen Houle and Robert <br />Engstrom) pursuant to Minnesota Statute 414.033 Subd. 2 (3). (Motion passed 4-0). <br />F. Conditional Use Permit Review: Jim McNamara <br />Jim McNamara provided a list of Conditional Use Permit holders in the City and gave a verbal report. <br />Hammes Mining — in litigation <br />Shafer Mining — Mr. Spicek has been notified of the ATV use and will put up more signs. The Sheriff <br />Department is also aware of the problem. <br />Armstrong — Count of 84 cars <br />Jamie Olson — sign is within limits <br />M/S/P DeLapp/John — to place a notice in the newsletter on ATV use not acceptable in the Shafer Mining <br />pit. (Motion passed 4-0). <br />9. CITY ATTORNEY'S REPORT: <br />Hammes Litigation (Executive Session) <br />10. UNFINISHED BUSINESS: <br />A. Signs on Upper 33'd Street <br />Councilor Dunn reported the maintenance crew were not putting up the signs where they were intended to <br />go as described in the diagram proposed by Dan Olinger at the June 3`a meeting.. Dan Olinger will attend <br />the next Council meeting and explain why he made the change. <br />M/S/P John/Dunn — to direct the staff to send a letter to the Lake Elmo Inn emphasizing the parking <br />problem and it is the intention of the City to prosecute violations and John Schultz draw this to the attention <br />of his customers. The Planner offered to go out and check the number of signs. (Motion passed 4-0). <br />11. CITY COUNCIL REPORTS: <br />Mayor John reported on the successful visit to the League of Minnesota Cities conference in St. Cloud. <br />Councilor DeLapp provided an article on West Palm Beach. <br />Councilor Dunn asked if the Fire Department could work with Mike Bouthilet in assistance with watering <br />the trees being stressed by the drought. <br />12. CITY ADMINISTRATOR'S REPORT: <br />A. 1996 Fire Department Annual Report <br />Chief Sachs presented the Lake Elmo Fire Department's 1996 Annual Report. The Council commended <br />him on a very well written readable report and thanked the Department for their efforts. <br />B. Appeal Planning Commission recommendation on Case V/97-32, Brookman Motors <br />Administrator Kueffner is appealing the decision of the Planning Commission to approve the variances <br />requested by Brookman Motors at its June 9, 1997 meeting after reviewing the application and supporting <br />data.
