Mayor John called the Council meeting to order at 7:00 p.m. in the Council chambers. PRESENT: Hunt, <br />Dunn, John, Conlin, DeLapp, City Attorney Filla, City Engineer Prow, City Planner Terwedo and City <br />Administrator ICueffner. <br />1. AGENDA <br />M/S/P Hunt/Dunn — to approve the August 5, 1997 City Council agenda as amended. (Motion passed 5-0). <br />2. MINUTES:July 8, 1997 <br />M/S/P Hunt/John — to approve the July 8, 1997 Council Minutes as presented. (Motion passed 2-0- <br />3:Abstain:Conlin, DeLapp, Dunn). <br />3. CLAIMS <br />M/S/P DeLapp/Hunt—to approve the August 5, 1997 Claims #6129 through #6184, as presented. (Motion <br />passed 5-0). <br />4. PUBLIC INFORMATIONAL/INOUERIES: <br />A. Public Inquiries: NONE <br />B. Resolution of Intent to Study Consolidation with Baytown Township <br />Baytown Commissioner Maynard Kelsey explained Baytown's reasons for pursuing both the annexation <br />and consolidation had to do with self-preservation and because Lake Elmo has a similar conservative <br />development philosophy. <br />Oak Park Heights Mayor Schaaf thought the consolidation study was a good idea, but that a Lake Elmo <br />annexation of the Kern Center was not because the property owners in the affected area are against it. <br />Mayor Schaaf claimed 85% of property in the annexation area support an Oak Park Heights annexation <br />over Lake Elmo. He added that these property owners as well as the City of Oak Park Heights will fight <br />Lake Elmo's attempt to annex this land. Oak Park Heights has already filed the annexation request. <br />Kevin LaCasse, Kern Center, voiced his concern on how the commercial business park would be affected <br />by Lake Elmo's policy plans and the viability for sewer and water. <br />Dave Screaton, owner of 50 acres, stated there were only 5 signatures on the Lake Elmo petition, but he <br />was one of 8 petitioners for annexation to Oak Park Heights. He stated the property owners have spent a <br />lot of money to be annexed into Oak Park Heights and will spend more to stay out of Lake Elmo. He asked <br />that Lake Elmo give up on the annexation of this area because the affected property owners do not want it. <br />Mayor John explained that Lake Elmo's annexation attempt is being pursued at Baytown Township's <br />request and that Lake Elmo's annexation petition is necessary to maintain the status quo until a Municipal <br />Board hearing is held. <br />M/S/P Conlin/Hunt — to adopt Resolution No. 97-42, A Resolution of Intent to enter into the consolidation <br />study process with the Town of Baytown as outlined by the Minnesota Board of Government Innovation <br />and Cooperation. (Motion passed 5-0). <br />C. Resolution supporting orderly annexation of 235 acres from Baytown Township <br />This was requested by Baytown Township and the petition was presented to Baytown Township and <br />unanimously voted by the Baytown Board. The Council received a Draft resolution that will permit an <br />orderly annexation of the portion of Baytown Township that lies West of Highway 5. This property <br />includes the Kern Center, a commercial center, and some scattered homesites. The population of this area <br />is 21. <br />M/S/P Hunt/Conlin — to approve Resolution No. 97-43, A Joint Resolution and Agreement between the <br />City of Lake Ehno and the Town of Baytown for Orderly Annexation of 235 acres as described in <br />resolution.
