2. MINUTES: April 7, 1998 <br />M/S/P Johnston/Hunt — to approve the April 7, 1998 City Council Minutes, as amended. (Motion passed 4- <br />0- I:Abstain:Councilor Dunn) <br />3. CLAIMS <br />M/S/P Hunt/Johnston — to approve the April 21, 1998 Claims, as presented. (Motion passed 5-0) <br />4. PUBLIC INQUIRIES/INFORMATIONAL: <br />A. Charitable Gambling License: Lake Elmo Jaycees <br />The Lake Elmo Jaycees have requested the State of Minnesota review its Charitable Gambling License. <br />Over the years, the Jaycees have been operating their Lawful Gambling at the Twin Point Tavern, located <br />at 11199 Stillwater Blvd. N. <br />M/S/P DeLapp/Hunt — to adopt Resolution No. 98-25, A Resolution approving the issuance of a charitable <br />gambling license by the State of Minnesota to the Lake Elmo Jaycees. (Motion passed 5-0). <br />B. Green Corridor Project: Michael Pressman <br />Michael Pressman, Land Stewardship Project presented the Green Corridor Project and described the tools <br />to keep open spaces. A brochure "Keeping Open Spaces for Tomorrow" was provided. Counciler DeLapp <br />volunteered to contact several people to serve on the Lake Elmo Environmental Commission <br />C. Tree Planting Program <br />Gary Perrault provided information on the Lake Elmo MnDOT Partnership Project, Native Plant Buffer <br />Zone Habitat Planting, Phase 1 —1998. Lynne Yoch announced that the tree planting (approx. 65 trees) <br />along Highway 5 and Jamaca Avenue is scheduled for Saturday, May 2"d at 9 a.m. <br />M/S/P Dunn/Johnston — to adopt Resolution No. 98-26, A Resolution Authorizing Application and Primary <br />Contact Person for the Lake Elmo MnDOT Partnership Project along Highway 5 and Jamaca Avenue. <br />(Motion passed 5-0). <br />5. CONSENT AGENDA: <br />6. CITY ENGINEER'S REPORT: <br />A. Escrow Reduction for Judith Mary Manor <br />The City received a letter from Lemmons & Lemmons requesting, on behalf of the developer for Judith <br />Mary Manor, an escrow reduction. Tom Prew has reviewed this request and submitted a letter, <br />recommending that the escrow be reduced to $68,575.00. <br />M/S/P DeLapp/Dunn — to approve an escrow reduction for Judith Mary Manor to $68,575.00 as <br />recommended by the City Engineer in his letter of April 15, 1998. (Motion passed 5-0). <br />7. MAINTENANCE/PARKS/FIRE/BUILDING: <br />A. Letter from Mr./Mrs. Gary Niemic regarding placement of neighbor's pole building <br />The City received a letter for Mr. and Mrs. Gary Niemic, 8271 Lake Jane Trail, expressing concern over <br />Jeff Taylor's intent to construct an accessory structure behind their house (8241 Lake Jane Trail), but which <br />would be in front of the Niemic home at 8271 Lake Jane Trail. Mr. Niemic provided the Council with <br />several opinions from real estate appraisers indicating that the placement of the building as proposed would <br />lower his property value.
