M/S/P Hunt/Johnston — to direct the staff to take these comments and work at putting together a possible <br />program for enforcement of these temporary signs. (Motion passed 4-0). <br />F. Letter from Doherty, Rumble & Butler <br />The Council received a letter dated April 7, 1998 from David Sellergren, Doherty, Rumble and Butler with <br />a request for sewer and water signed by owners of property located within the I-94 Corridor Study Area. <br />Attorney Filla told the Council that the request was not an official legal petition, but the Council should not <br />ignore the request. The Council suggested waiting until after the I-94 Task Force meeting on Wednesday, <br />April 8, to see if a decision is made about whether it is going to try to accommodate this request in some <br />manner. Then the Council will schedule time for discussion at a regular Council meeting and decide if we <br />are going to meet with our neighbors. <br />9. CITY ATTORNEY'S REPORT: <br />Attorney Filla reported that on February 18' the Municipal Board made a preliminary decision on <br />annexation of 240 acres. The Board asked Attorney Magnuson to prepare a legal description, which <br />included Kern Center and Kern Center II. The response we made to the Municipal Board was it included <br />Kem Center, Kern Center II, and Stillwater Motors. Attorney Vierling, OPH, responded to the Board he <br />thought they mistakenly excluded the Ag zoned Buberl property. Filla responded it was intended to include <br />Kern Center, Kern Center II and Stillwater Motors, not the Buberl property. This was scheduled to be <br />resolved on April 3`d, but has been continued to April 17`h. On March 2nd, Lake Elmo received a letter from <br />the Community Development Division of the Metropolitan Council, stating if this property goes to Lake <br />Elmo as the Board has preliminary decided, it can be developed; either connected by sewer or at a rate of <br />one unit per 40 acres. The Screatons have now requested the Hearing be reopened and argue that they have <br />no use of their property because this property can only be one unit per 40 acres or included in the MUSA. <br />On April 17d, the Municipal Board will take up the issue of the legal description and come to a conclusion <br />whether to allow the hearing to be reopened to accept additional information on this issue. If they decide to <br />allow the Hearing to be reopened, another date will be scheduled. <br />M/S/P Hunt/Johnston — to direct Attorney Filla to respond to Attorney Scott McDonald's motion of April <br />3'd, before the deadline of April 10, 1998 asking for background for this letter, why and when was it written <br />and who decided to do this. (Motion passed 4-0) <br />10. UNFINSIHED BUSINESS: <br />11. CITY COUNCIL REPORTS: <br />Councilor Hunt will be meeting with the Human Rights Commission. <br />Councilor Johnston attended the General Government Subcommittee that had a discussion on how to <br />combine the Boards. Baytown would have a representative through the ward system. The next meeting is <br />scheduled for April 20th, 7 p.m., at the Civil Air Patrol Hanger. <br />12. CITYADMINISTRATOR'S REPORT: <br />A. League of Minnesota Cities Annual Conference <br />Mayor John and Councilor Hunt indicated they would be attending the League Conference on June 16-19 <br />in Duluth. Councilor Johnston will not attend the conference and Councilors Dunn and DeLapp will call <br />the staff if they decide to attend. <br />B.
