if Imation is going to allow more water than what the City agreed to, Lake Elmo should be notified. The <br />City cannot unilaterally make any changes to the agreement we have with 3M and Oakdale. Mr. McCulley <br />voiced his concern if the City of Lake Elmo would approve an amendment to the Joint Powers Agreement <br />for Oakdale, 3M, to purchase storage capacity, the Association would not be involved. The City has a <br />formal agreement with Oakdale and VBWD stating that runoff from Imation land and entering 3M property <br />in Lake Elmo will not leave that property without meeting our rate and volume requirements. Filla <br />responded that this is private property and didn't think that Imation, VBWD, or the City can respectively <br />use this for a public purpose without acquiring some additional rights from the owner —so the Association <br />would have to be involved. Filla voiced concern of having the VBWD added to this discussion because the <br />City has not been made aware of VBWD's plans in using this property. <br />M/S/P Hunt/Johnston - to approve the grading permit requested by Glen Rehbein Excavating, Inc. for <br />Wildflower Shores, based on the grading plans prepared by Glen Rehbein Excavating, dated March 10, <br />1998, and made part of this permit, based on the recommendation of the City Engineer, to include the 15 <br />conditions, as amended. (Motion passed 4 —0). <br />C. Ordinance declaring moratorium in PF zoning districts <br />Planner Terwedo reported the Council directed the staff to prepare an ordinance establishing a <br />Development Moratorium in the PF Zoning District. The Planning Commission has reviewed the PF <br />ordinance and recommended modifications as outlined in the PZ minutes of March 23, 1998. The Planning <br />Commission discussed the 15-acre parcel of land along 1 Oh Street and recommended that the long-range <br />plan for the area be directed as Open Space Development Area due to adjacent land uses. <br />M/S/P DeLapp/Hunt — to adopt Ordinance No. 9728, An Interim Ordinance Placing a Development <br />Moratorium on Property Located Within the Public Facility (PF) Zoning District of the City. (Motion <br />passed 4-0). <br />M/S/P DeLapp/Hunt - to adopt Summary of Ordinance No. 9728 establishing a Development Moratorium <br />in the (PF) Zoning District. (Motion passed 4-0). <br />D. Extension of filing of Final Plat: Meehan Family <br />Torre Pines was given preliminary plat approval in July 1998, and final plat approval for all but the three <br />lots in September 1995. The City was informed at that time that Mr. Meehan would continue to live in the <br />existing home on the 10 acres, and that the final plat for these four lots would not be done at this time. The <br />Meehan's are requesting another one-year extension. Our Code allows for this extension, but requires <br />Council approval on a yearly basis. The staff had no concerns and supported the request. <br />MIS/P DeLapp/Hunt — to grant the Meehan's a one-year extension of the final plat of Torre Pines, <br />specifically, the parcel now shown as Lot 15. (Motion passed 4-0). <br />E. Direction of Enforcement <br />Administrator Kueffner asked the Council if it wants staff to come on weekends and enforce the current <br />sign ordinance and remove the temporary "flip" signs out of the right-of-way. Councilor DeLapp <br />explained, several years ago, Dakota County had a $10 fine for each sign. Temporary signs in the right-of- <br />way are against MSA regulations. These people would be guilty of a misdemeanor. Attorney Filla <br />suggested attaching a notice stating placement of the sign is against the following sign ordinance, and the <br />signs will be removed and taken to City Hall. Councilor Hunt suggested having a policy requiring the <br />Maintenance crew look out for these signs during normal work hours, tagging them, and notifying the <br />developer by letter. The Council suggested the staff thinks about this and come back with a method of <br />enforcement and find out how Dakota County enforces their regulations. Administrator will check with the <br />County if picking up these signs in the County right-of-way would be considered stealing by the City. <br />LAKE ELMO CITY COUNCIL MINUTES APRIL 7, 1998 <br />
