Since he has not done any grading, he owes the $17,590. <br />M/S/P Hunt/DeLapp —to direct the staff to consult with Mike Bouthilet concerning the developer's <br />obligation, what was he given credit for, check the status of land for delinquent taxes, contact developer of <br />Stonegate to let him know this will be on a future agenda, check into money left in trail budget, get an <br />updated plat map for lots around Goose Lake, and make a final recommendation and notify the Parks <br />Chairman when this item is on the Council agenda, (Motion passed 5-0). <br />B. Countryside Pool & Spa Inc.'s Appeal of Decision of Code Enforcement Officer <br />M/S/P Dunn/DeLapp — to postpone Agenda Item 6B until the applicant has been notified. (Motion passed <br />5-0). <br />7. CITY ENGINEER'S REPORT: <br />A. Partial Payment to Tower Asphalt <br />Tom Prew reported that Tower Asphalt is proceeding with work on the 30a' Street Reconstruction and 1998 <br />Overlays and is on schedule with these projects. Janero Avenue has been deleted from the contract. <br />M/S/P DeLapp/Hunt — to approve Partial Payment Number I in the amount of $202,691.94. (Motion <br />passed 5-0). <br />M/S/P Hunt/Johnston — to approve Change Order Number 1, removing Janero Avenue from the Contract. <br />(Motion passed 5-0). <br />B. Road Curbs <br />Councilor DeLapp asked that the City look at why they have curbs and come to a consensus. He submitted <br />sketches of two different standards for curbs. One sketch denotes a clear zone for equipment and large <br />emergency vehicles. <br />M/S/P DeLapp/Hunt — to submit the sketches of curbs, submitted by Councilor DeLapp, to the City <br />Engineer, Maintenance Supervisor, Planner, and Fire Department, to discuss what is practical and <br />acceptable for the City. (Motion passed 5-0). <br />8. PLANNING, LAND USE & ZONING: <br />A. File 98-11:Zintl Open Space Concept Plan <br />At the August 4th Council meeting, Tim Freeman, the applicant's consultant, requested this application be <br />tabled until such time as all Council members were present and voting, or until such time as the applicant <br />advised the City that they desired to proceed. Mr. Freeman delivered a revised Concept Plan on August 12, <br />1998, which reflects the following changes from their August 4a' plan. 1. Home sites on lots along the east <br />periphery have been adjusted to result in full 200' setback from the Fields of St. Croix property line, 2. The <br />public street right-of-way has been extended to the south property line, and 3. The proposed public park has <br />been reduced in size from 6 acres to 3.8 acres as a result. 4. Several of the proposed lots have been reduced <br />in size (remain in excess of Yz acre) and the area subtracted from the lots has been added to the Open Space. <br />5. The cul-de-sac at the south end of the public street is now proposed to be "temporary", without the <br />secondary village green characteristics formerly proposed. The Open Space calculations now exclude the <br />wetlands from both net land area and from the open space proposed.
