M/S/P DeLapp/Johnston — to authorize the Mayor and Administrator to execute a contract with the <br />Metropolitan Council to receive digital air photos at no cost to the City. (Motion passed 4-0). <br />E. PUBLIC HEARING: Variance to mound system: 858 Julep Avenue N., Chang/Lake Elmo <br />Country Homes <br />The Public Hearing was published in the Stillwater Gazette and the adjoining property owners were <br />notified. <br />Albert and Elaine Chang/Lake Ehno County Homes have requested a variance to permit a mound system <br />for new construction at 858 Julep Avenue N. The applicant submitted soils analysis that indicated <br />seasonal ground water levels that preclude construction of an underground treatment system. It appears <br />that the grading plan for Stonegate II prescribed a drainage -related Swale on this lot that resulted in <br />disqualifying a large area of the lot for a treatment system due to soil compaction. City Engineer Tom Prew <br />reviewed this variance request and recommended approval. <br />Acting Mayor Hunt opened up the public hearing at 7:55 p.m. in the Council Chambers. <br />There was no one to speak for or against the variance request. <br />Acting Mayor Hunt closed the public hearing at 7:56 p.m. <br />M/S/P DeLapp/Johnston — to approve a variance to Section 700 of the Lake Elmo Municipal Code to allow <br />a private mound septic system or wetland treatment system as the first disposal site at 858 Julep Avenue <br />North based on the condition that mound system construction would blend into the landscaping in order to <br />have a minimized impact of view. (Motion passed 4-0). <br />F. Resolution granting garage closer to propertyline: Bill Regan/Linda Hanke at 8108 Hill Trail N. <br />Bill Regan and Linda Hanke want to construct a 12' x 20' garage at 8108 Hill Trail N. According to <br />Section 303.13, Sub. 3J., a lake frontage lot requires a resolution to erect the accessory building closer to <br />the road (Hill Trail N.) than the principal building. The garage meets all other required setbacks in the R-1 <br />Zoning District. <br />M/S/P Johnston/Dunn — to adopt Resolution No. 98-44, A Resolution approving the placement of an 12" x <br />20' accessory structure closer to Hill Trail N. than the principal structure for Bill Regan and Linda Henke at <br />8108 Hill Trail N. (Motion passed 4-0). <br />G. 1998 Comprehensive Plan Update <br />Administrator Kueffner explained Council discussion on the mandated December 31, 1998 Comprehensive <br />Plan Review has been somewhat limited. It has been assumed because of the consolidation study efforts <br />now underway, the Metropolitan Council will grant the City an extension. A representative from the Met <br />Council indicated they did not have a process in place yet for communities that would request extensions, <br />but development of that process is, itself, in process. Administrator KuefSier asked the Council to direct <br />the Planning Commission to proceed with the Comprehensive Plan amendment for the newly annexed area <br />(from Baytown). This will be an element of the new Comprehensive Plan, but should be done within the <br />timeframe of the moratorium, and can be done as a separate amendment. <br />M/S/P DeLapp/Johnston — to direct the Planning Commission to proceed with the Comprehensive Plan <br />amendment for the newly annexed area of Baytown. (Motion passed 4-0). <br />H. Zintl Open Space Concept Plan— File OPC/98-11 <br />Planner Dillerud reported that at its July 7, 1998 meeting, the City Council tabled consideration of this <br />Concept Plan to enable the applicant to address existing conditions and design concerns raised during the <br />LAKE ELMO CITY COUNCIL MINUTES AUGUST 4, 1998 <br />
