Bob Engstrom presented a concept with an open space viewshed along Highway 5. The intended park will <br />be for the use of residents living in the development. Terry Emerson added this is a working sketch. Mary <br />Jean Dupuis, affected landowner, would like more input down the road. <br />Kes Tautvydas, Chairman of the Parks Commission, referred to the park indicated on the concept plan and <br />stated this is not what the commission had in mind. The amount of acreage (11.2 acres for a park with an <br />additional 3 acres given up by the City), if located adjacent to Highway 5, could accommodate a large <br />ballfield that can also serve as a soccer field. The park would be accessible from Highway 5 and be <br />available to all City residents. <br />Councilman DeLapp indicated that the concept was generally consistent with what he thought the Council <br />had in mind by showing co-ordination of roads, housing, and open space. <br />C. Ordinance to remove properties from Village Moratorium <br />As directed by the Council on November 5a', the City Attorney prepared an ordinance redefining the <br />Village Moratorium area by removing the affected parcels. Exhibit A to the draft ordinance depicts the <br />current geographic extent of the Moratorium, while Exhibit A-1, as amended, depicts the extent of the <br />Moratorium should the ordinance be adopted. Planner Dillerud explained four small additional parcels <br />with existing homes must be removed as well to preserve geographic continuity of the resulting <br />Moratorium area. Mr. Freeman indicated that another property owner (Smith) of 10 acres adjacent to the <br />west line of the Screaton parcel would be included in their concept due to land trades now contemplated. <br />Exclusion of that parcel is also included by the draft ordinance. <br />Council member Armstrong voiced her opposition to removing the property from the moratorium early <br />stating that Council members should consider the purpose of a moratorium. She likes open space along <br />Highway 5, but does not like small lots. If the Council approves deleting these properties out of the <br />moratorium, it would have to honor any other requests. <br />Councilor DeLapp stated the City doesn't have any other property that wants to come out of the <br />moratorium. Planner Dillerud responded that he has been contacted and would get calls to get out of the <br />moratorium. He has concerns on what justification he would use. <br />Council member Dunn voiced her opposition to clumping of houses and small lots, the dense park use and <br />opposed the request to remove the property form the moratorium. She added that the Village Commission <br />is concerned with premature modifications to the Village Moratorium geographic area. <br />Attorney Filla asked Mr. Freeman when he thought he would be back with a concept plan. Freeman <br />responded it's possible to have the plans ready in December, preliminary plat in January or February, and <br />be ready for spring construction. <br />The Council discussed the ordinance decreasing area subject to development moratorium and suggested <br />deleting Item 1.0 E. and make Item F into Item E. <br />M/S/P DeLapp/Hunt — to adopt Ordinance No. 9737, An Ordinance Decreasing Area Subject to <br />Development Moratorium as shown in Exhibit A-1 based on the following Findings: <br />1. That the concept plan includes property owned by multi -property owners, some within the moratorium <br />area and some out of the moratorium area already. <br />2. That the concept plan includes Phase #2 of Fields of St.Croix, which is part of the property already <br />platted, and an approved development. <br />3. That the concept plan includes a large amount of total acreage. <br />4. That the concept plan shows the ability to leave as Open Space the land abutting the remaining <br />moratorium land on the South and West. <br />5.
