LAKE ELMO CITY COUNT: MINUTES DECEMBER 1, 19, . 2 <br />Mayor Hunt called the Council meeting to order at 7:00 p.m. in the Council Chambers. PRESENT: <br />Armstrong, Hunt, Johnston, DeLapp, City Attorney Filla, City Engineer Prew, City Planner Dillerud and <br />Administrator Kueffner. ABSENT: Council member Dunn. <br />1. AGENDA <br />M/S/P DeLapp/Johnston — to approve the December 1, 1998 City Council agenda, as amended. (Motion <br />passed 4-0). <br />2. MINUTES: November 17, 1998 <br />M/S/P DeLapp/Johnston - to approve the November 17, 1998 City Council minutes, as amended. (Motion <br />passed 4-0). <br />3. CLAIMS <br />M/S/P Johnston/DeLapp - to approve the December 1, 1998 Claims, as presented. (Motion passed 4-0). <br />4. PUBLIC INOUIRIESANFORMATONAL: <br />A. Public Inquiries — NONE <br />B. Oak Park Heights Public Hearing <br />Administrator Kueffner provided the Council with a copy of the Oak Park Heights Planning Commission <br />Meeting Agenda for December 3, 1998, which included a public hearing to consider establishing a B-3 <br />Highway Business and Warehousing District in the Oak Park Heights Zoning Ordinance, and to consider <br />rezoning the Kern Center from 0, Open Space to B-3, Highway Business and Warehouse District. She <br />referenced Page 4, b., which states "The Conformity with Present and Future Land Uses in the Area". <br />"Land uses within the City to the east and within Lake Elmo to the east and south would be compatible <br />with the Kern Center as a B-3 District. Within its Comprehensive Plan, the City has planned for a <br />detachment and annexation of the areas within Lake Elmo directly to the west and south of the Kern <br />Center. The land use plan has anticipated land uses compatible with the B-3 zone as part of this area <br />designated for future annexation. To the east, Highway 5 acts as a border for the transition to retail <br />commercial areas and the Stillwater Area High School." <br />Administrator Kueffner stated she did not believe that one City could plan for another City. Lake Elmo has <br />seen a draft of an Oak Park Heights Comprehensive Plan, which was deemed by the Met. Council to be <br />incomplete and put on hold. She stated she advised Oak Park Heights, and the preparer of the Plan that the <br />City would expect to review the revised Plan when it was completed. Lake Elmo and Baytown had spent <br />$50,000 on the annexation issue of this property and the Municipal Board has made a decision. Lake Elmo <br />adopted a moratorium for this area while a Comprehensive Plan amendment was prepared that has been <br />sent to the Met. Council for comment. Also, there is a moratorium in the Brown's Creek Watershed <br />endorsed by the City, and adopted by Washington County, that affects a portion of this area. She stated she <br />felt that ignoring two moratoriums, and the planning rights of another City, was the epitome of arrogance <br />and insensitivity, and asked that the Attorney be directed to review the analysis and report back at the <br />December 8`h Budget meeting. <br />Planner Dillerud talked to Scott Richards, drafter of this report, regarding Baytown Township and their <br />land use plan, which includes 200 acres in Lake Elmo. Dillerud asked him how could extra territorial <br />planning be justified. Richards replied that the original blueprint calls for some of these areas to be <br />urbanized within the near future. Richards will send Lake Elmo a copy of the proposed Land Use Plan, <br />which has not been adopted. OPH had already done a water system plan amendment and submitted the <br />plan to Metro Council, but again not to Lake Elmo. Exhibit C of the report shows OPH corporate limits <br />after the annexation; the land use map does extend to the south and west. <br />A copy of this report, secured by Lake Elmo, was sent to Pat. St. Claire, Baytown Township Clerk, who <br />also had not seen it. Baytown Supervisor, Brian Nichols, was in attendance at this meeting.
