If <br />the AG and RR zoning ordinance text amendments are approved, OP development in the AG and RR zones <br />will only be allowed with a Conditional Use Permit. <br />M/S/P Armstrong/Johnston —to adopt Resolution No. 98-68, A Resolution amending the Land Use Map of <br />the Comprehensive Plan by removing all OP (Open Space Development) classifications, and applying <br />RAD (Rural Agricultural) on the affected parcels, subject to Metropolitan Council review. (Motion passed <br />4-0). <br />E. Zoning Ordinance —AG/RR Text Amendments — OP as Conditional Use <br />At its November 23, 1998 meeting, the Planning Commission unanimously adopted a recommendation to <br />amend the Zoning Ordinance with respect to Conditional Uses in the AG (Agricultural) and RR (Rural <br />Residential) zones. The Commission recommended this zoning text amendment as a compliment to the <br />Land Use Map amendment regarding OP to RAD. The use of the CUP process, with appropriate findings <br />of fact related to the Open Space Preservation portions of the Comprehensive Plan text, should overcome <br />the inappropriate application of the OP development process on sites not well suited for it. Planner <br />Dillerud will add strength to the OP Ordinance by following up with a set of performance standards in <br />addition to the OP. <br />M/S/P Armstrong/Hunt — to adopt Ordinance 9740 — An Ordinance amending Chapter 300 of the City <br />Code to allow OP development in AG and RR zones by Conditional Use Permit only. (Motion passed 4-0). <br />F. Comprehensive Plan Update — Due Date Extension <br />Planner Dillerud reported that Lake Elmo is not alone among Metro communities that do not anticipate <br />completion of its Comprehensive Plan by the original due date of December 31, 1998. Dillerud will <br />provide the Metropolitan Council with the following factual basis for an extension request. <br />1. Lake Elmo is awaiting a Metro Council decision regarding the WONE interceptor alternative for <br />providing regional sanitary sewer to the I-94 corridor. The amount and location of land use planned <br />for urban service is partially dependent on the decision regarding that alternative. <br />2. The Comprehensive Plan update, as to land use and other elements, is also partially dependent on <br />completion of the Village Study. (The scheduled completion date is March 31, 1998.) <br />3. The two communities regarding the Lake Elmo/Baytown Township consolidation render will have a <br />significant impact. We may be looking at a Comprehensive Plan update incorporating thousands of <br />additional acres during 1999 should the communities decide by referendum to consolidate. (The <br />earliest a decision can be expected regarding consolidation would be March, 1999.) <br />Planner Dillerud recommended Lake Elmo request an extension to December 31, 1999 based on the <br />foregoing and the mandatory 6-month review period adjacent cities/townships. <br />M/S/P Johnston/Armstrong — to adopt Resolution No. 98-69, A Resolution requesting an extension of the <br />December 31, 1998 Due Date for Review of the Lake Elmo Comprehensive Plan for Consistency with <br />Amended Metropolitan Council Policy Plans to December 31, 1999. (Motion passed 4-0). <br />G, Tax Abatement Program <br />M/S/P DeLapp/Johnston — to direct the staff to prepare the necessary resolution for the December 8`h <br />Budget meeting regarding implementation of a Tax Abatement Program.
