moratorium. The development is too dense for the area. The Council should look at each parcel <br />individually). <br />The Council approved the following Amendments: <br />1. The 17 dwelling units proposed by the Concept Plan as "Phase III" are identified as townhouses. A <br />development state plan for these dwelling units shall be submitted concurrent with the balance of <br />Fields 2id. <br />2. "Transfer" of 17 dwelling units to Fields 2"d from the Fields of St. Croix first plan is approved in <br />Concept provided that the Development Stage Plan include a legal vehicle to accommodate such <br />transfer. <br />M/S/P DeLapp/Siedow - to adopt Resolution No. 99-13, as amended, approving the OP Concept Plan for <br />Fields of St. Croix 2"d, based on the findings and subject to the conditions recommended by the Planning <br />Commission. (Motion passed 4-I:Armstrong: For the same reasons she voted against Tana Ridge and <br />Emerson/Forliti Concept Plan.) <br />F. Release of Development Security — Heritage Farm <br />Planner Dillerud reported that on November 17d', 1998, the Council accepted all public improvements <br />constructed within Heritage Farms and reduced the development security held by the City to $15,000. The <br />retained security was to determine the status of a bridge the developer constructed on the rail system and to <br />permit the City to calculate and invoice the developer for internal staff expenses related to the development. <br />Tom Prew inspected the bridge and noted some design deficiencies. Attorney Filla has advised staff that <br />the bridge status is clearly a Homeowner Association matter, not the City's. <br />M/S/P Armstrong/DeLapp - to authorize release of Lake Elmo Bank Letter of Credit #283 as Development <br />Security for the Heritage Farm development upon payment to the City of the Final Notice for <br />administrative services. (Motion passed 5-0). <br />G. Comprehensive Plan Amendment Northeast Annexed Area <br />Planner Dillerud reported the City Council approved a Comprehensive Plan Amendment for the Northeast <br />Annexed Area, subject to Metropolitan Council concurrence, on November 5, 1999. The approved Land <br />Use Plan specified OP for the entire 190+ acre area, except the 3 acre church parcel (PF — Public Facilities) <br />along Highway 5. <br />By its letter of December 8, 1998, the Metropolitan Council staff finds the City -approved amendment <br />incomplete for Council review. The Met Council staff objection to the amendment relates to the permanent <br />open space feature of Lake Elmo's OP classification in the Urban Reserve designated by the Regional <br />Blueprint. They observe that the open space created by the OP could never be urbanized, therefore, <br />effectively removing it from their Urban Reserve inventory: <br />Since the November submission to the Met Council, the City has changed its Land Use Pan to substitute <br />RAD guiding where OP guiding appeared previously; and, amended the Zoning Ordnance to make OP <br />Cluster Development Optional (as a Conditional Use) within the AG and RR zoning districts of RAD <br />guiding rather than mandatory, as was the case with OP guiding. <br />Due to both the Met Council's review comments and the City's changes to OP Plan and zoning structure, <br />the Planning Commission reheard the Northeast Annexed Area Comprehensive Plan Amendment on <br />January 11 and January 25.
