Pastor Michael Friend, Apostolic Church, stated he had an opportunity to speak except for at the last
<br />meeting. Progress has been made, positive for churches. It was a ridiculous ordinance. Where did the 15
<br />acres come from? The 15-acre lot size unconstitutionally infringes on the exercise of religion and is
<br />unsupported by any rational basis. Perception is the church can't build on 15-acres with a buffer. Apostolic
<br />wants to build a church in Lake Elmo that serves the rural setting, but felt the size is restricted. You can't
<br />grow your ministry then. Hopes to construct a church housing 1,000 to 1,200 members and stresses he was
<br />not trying to change the rural setting or upset the flow of the City.
<br />Wyn John, 8883 Jane Road N., former Mayor of Lake Elmo, stated the 15 acre site size was adopted as
<br />what was felt to be reasonable for a maintenance facility, local parks and also for churches. Restricting the
<br />site size was intended to avoid the development of a location, which would dominate and affect the
<br />character and infrastructure of an entire neighborhood. The set backs adopted are similar to all other zones,
<br />with no thought given to their relaxation in favor of one particular classification. Wyn John's submittal is
<br />made part of the Council minutes.
<br />Mayor Hunt read letters, which are made part of the minutes, that were received from Nate Sabin, 8080 59s'
<br />Street and Ann Bucheck, 2301 Legion Avenue, and telephone message from Diane Driscoll, 8737
<br />DeMontreville Trail N.
<br />Rod Sessing, 5697 Keats Avenue N, Planning Commission member, provided calculations on how large of
<br />a building and the number of parking stalls can be placed on 15 acres with 35% impervious surface. The
<br />calculations are made part of these minutes.
<br />Tim Mandel, 2479 Lisbon Avenue N., Planning Commission member, stated 35% impervious coverage is
<br />too high. He cares about the groundwater, the buffer is added to shield adjacent property from noise and
<br />lights and keep up property values. If 1,472 people go to Church at one time, and you multiply this by 5,
<br />this would equal all the population of Lake Elmo.
<br />Kathy Sedro, 8916 35 s St. N. and Planning Commission member, provided research on Impervious Surface
<br />Coverage, The Emergence of a Key Environmental Indicator from the University of Connecticut. The 35%
<br />limitation on impervious surface is too high of a restriction. It does not consider wells, degradation of
<br />water supply. She considers a maximum of 10% impervious surface coverage reasonable. The submittal
<br />on Impervious Surface Coverage is made part of the minutes.
<br />Diane Taylor, 8586 Lake Jane Trail, stated she was very offended by the letter sent. She has been treated
<br />fairly by the staff, Planning Commission and City Council regarding their concern on driveway location in
<br />the Final Plat of Waters Bay.
<br />Attorney Filla asked for time to read the letter and submittals from Attorney Peter Beck.
<br />M/S/P Armstrong/DeLapp — to postpone the amended Public Facilities Ordinance in order to make the
<br />appropriate changes on the PF Ordinance and to allow the City Attorney, staff, Council to review the
<br />information submitted and provide a response on documents. (Motion passed 5-0).
<br />C. Repealing Resolution 97-46 Lot Line Adjustment: Gaylen Springborn
<br />Administrator Kueffner reported that on August 5, 1997, the Council adopted a resolution granting Gaylen
<br />Springbom a Minor Subdivision (lot line adjustment). This resolution was never recorded, as Mr.
<br />Spring -born had not yet met all the conditions. Now, he has sold the entire parcel, both A&B to one person,
<br />so the minor subdivision is no longer required. In order to keep the record straight, the Administrator asked
<br />the Council to take formal action to repeal Resolution No. 97-46, and this is at the request of Mr.
<br />Springbom.
<br />M/S/P Dunn/Armstrong — to repeal Resolution No. 97-46, adopted August 5, 1997, granting a minor
<br />subdivision to Gaylen Springbom, at the request of Mr. Springbom. (Motion passed 5-0).
