9. CITY ATTORNEY'S REPORT: <br />A. Montgomery Barrels <br />City Attorney Filla provided a copy of his March 12, 1999 letter to Tim Montgomery regarding an illegal <br />use in the residential zoning district. <br />M/S/P DeLapp/Armstrong β to direct the City Attorney to commence civil action against Tim Montgomery <br />with an illegal use in a residential zoning district. (Motion passed 5-0). <br />10. CITY COUNCIL REPORTS: <br />A. Mayor Hunt received a letter from Washington County Commissioner Bill Pulkrabek <br />asking for an elected representative and a staff person to attend quarterly meetings with the "Kitchen <br />Cabinet. <br />M/S/P DeLapp/Dunn βto accept the invitation of Washington County Commissioner, Bill Pulkrabek, and <br />designate Mayor Lee Hunt as the elected representative for Lake Elmo and Administrator Mary Kueffner as <br />the designated staff person to attend quarterly meetings with the "Kitchen Cabinet". (Motion passed 5-0). <br />B. Council member Rose Armstrong attended the 622 Elected Officials meetings and did <br />forward information she received from Washington County regarding an abandoned house in Lake Elmo. <br />C. Council member Siedow received a call from a new resident, who could not get a <br />certificate of occupancy from the Building Official because the lights on the house are illegal. Siedow <br />went out and looked at the lights and found them not to be bright and reflected the light down and not out. <br />He asked the Council to consider modifications to the light ordinance. Council member Dunn received the <br />call and thought it was the style of lights that were being objected to. The City Planner has gathered <br />information from the EPA and is working with Council member DeLapp on examples of lights that meet <br />the intent of the ordinance. The Building Official has a book on light fixtures that do meet the ordinance <br />and can be reviewed by residents. Also, it was found that some of the contractors had been interpreting the <br />City's lighting ordinance incorrectly. Ann Bucheck asked the Council not to repeal the light ordinance <br />because this would take away the darkness and you would not be able to see the stars. <br />11. UNFINISHED BUSINESS: NONE <br />12. NEW BUSINESS: <br />Council member DeLapp asked the Council if they are interested in considering allowing churches in every <br />zoning district under certain conditions and come back with pros and cons and then passes it on to the <br />Planning Commission. <br />M/S/P Armstrong/DeLapp β to discuss under Planning, Land Use and Zoning, amending the business zones <br />to include some or all of the PF uses as permitted; subject to business development standards. Most PF uses <br />are already permitted in GB, so the zones involved would be HB, LB and BP. (Motion passed 5-0). <br />Council member DeLapp asked the Council to consider discussion -involving development of a use <br />intensity approach to allow PF type uses in Ag and residential zoning districts. Planner Dillerud explained <br />another term for this regulatory strategy is Performance Zoning <br />M/S/P DeLapp/Armstrong β to discuss ideas to pass on to the Planning Commission on PF uses in Ag and <br />residential zoning districts, as allowed conditionally, set aside by the comprehensive Plan.
